Jonny also fails to prove some of the other elements of negligence, but I’m not teaching Jonny first-year torts, and so I’m not going to go on about the elements of negligence.

The second allegation is that the failure to install the strobe alarm has caused a “loss of enjoyment of property due to constant anxiety”. This one is even dumber.

First, “loss of enjoyment” is a term usually used in the context of personal injury. For example, when Jonny inevitably runs someone over, they will sue in part for loss of enjoyment of life due to their injuries. As noted above, no actual injury is alleged by Jonny in this action.

Loss of enjoyment of property would normally be considered as nuisance or trespass. Neither of these are made out. Regarding nuisance, Jonny does not show that an act by the strata caused a substantial and unreasonable interference with Miriam’s property rights. Trespass is clearly not at play.

Additionally, there is a duty to mitigate loss. A plaintiff must take reasonable steps to minimize the loss caused by the defendant. Failure to mitigate usually reduces damages awarded because the plaintiff has, in a sense, added to the injury.

In this case, the ability to mitigate the “loss of enjoyment” and mental distress, even if that occurred, is clear. All he had to do was to BUY THE FUCKING ALARM HIMSELF. No court will order damages for $30k in suffering when the solution was so cheap and easy, and most importantly, easily accomplished by the plaintiff.

Jonny also wants the court to order “remediation”. That is not something the Provincial Court can order as it would be a type of mandatory injunction and thus outside the Court’s jurisdiction.

This is actually some weird human rights bullshit that Jonny isn’t taking to the HRT because he knows they are on to him. Looks like the Provincial Court is too, which is why I suspect he is filing everything in his mother’s name.

A Vancouver Island wheelchair user who has spent years asking her strata for changes to make it possible to go to and from her condo safely and without help from friends has won $35,000 in damages and an order for action on her complaints.

Last week, the B.C. Human Rights Tribunal ordered the owners at the Eagle Point Bayview complex in Nanaimo to begin the process of making their building wheelchair accessible, and to pay a penalty to 76-year-old Ada Jacobsen for injury to her dignity, feelings and self‐respect.

"She has essentially been a prisoner in her own home ... Each time Ms. Jacobsen wants to go somewhere, she has to plan ahead with one of her friends so they can assist her," tribunal member Grace Chen wrote in a Sept. 11 decision.

"No one should have to spend their golden years fighting with their strata to get their accommodation requests addressed."

Chen said the strata didn't make any serious attempts to deal with Jacobsen's concerns about accessibility until she filed her human rights complaint.

eta2: Just noticed the handwriting on her claim - is it hers or jonny's? Either way, each has had 34 years to learn to write legibly, perhaps longer for her.

What hat? Lol. I've joked about it here before but dysgraphia is a recognised co-morbidity in people with autism and Asperger's disorder. It would not surprise me in the least if Yaniv fell somewhere on that spectrum.

My 'mad at the internet' hat bc I am infuriated by Johnny's atrocious penmanship.

And sure he obviously has learning disabilities but I still find it impossible to believe that he's ever practiced handwriting ever in his life, I think he's a damn lazy slug content with having mumsy handle it all until he reached late adulthood and now can't be bothered to improve even a little.

I would be INSANELY embarrassed if I wrote THAT badly.
 
It will be fascinating to see how the Strata lawyers handle JY here? I .ean here he is, a non party, that is agressively driving up the Stratas legal costs. This isn't a pro se litigant. This is a non lawyer seeking to practice law for someone else, which forces the defense to pay for his ineptness. I cannot see a Judge tolerating this for long.

On the 10th he filed for a location change... 4days later he turns up at the very same court he's scared of attending (despite it being a tele conv job). Yesterday's baying mob must have been horrendous.

Time's money. He's now copying and pasting the same guff from his own request to his mothers...on par with miriam and ilana's RCMP "injuries".

I'm enjoying his ongoing rage with Kari and Donald.

The hearing was scheduled for room 309 which is a virtual hearing room only. I'm not even sure if room 309 exists as a physical room.

So Jon and Miriam showed up at the courthouse expecting to walk into a room to see a judge, but the judge was sitting in her own office phoned into the hearing herself.

Miriam's legal advocate expert was told about this and was asked to phone into the hearing, same as every other person.

Thanks for the explanation. So Perry Mason and his legal assistant, terrified and disabled to oblivion, physically attend court for a virtual hearing. Canada's finest.

I take it their selective hearing problems weren't a problem that day.:roll:

In order to make the claim the courthouse was far to dangeroys for them to show up to (pay no mind to how many days they were there last week)
