The victim has to be present to tell her story so the defense can poke holes in it to create reasonable doubt, because that's where the judge will make the decision based off the live testaments and evidence shown in court to see if it's worth going to actual trial or not.

At this point, there is just the judge, the defender, the prosecution and people who want to watch in the courtroom. The victim can choose to either sit outside the courtroom or be in the office of the CAVAC (Centre d'Aide aux Victimes d'Actes Criminelles) if available.

Source: Well, I was a victim of SA in the province of Quebec and my case stopped at the pretrial.

Mae does not need to be present, it's an International dispute (she is in the US) and he is scrounging off Canada. International border legislation is different and they would not expect her to attend in person. As for video evidence, they have DNA evidence of a SA due to semen within her - that would allow for just a video to be created and not to do a live feed due to the stress. They could ask questions but it would require a delay.

The only mention she made of dna (presumably inside her )was “pre-cum” and she only said this in the messages they sent back and forth to each other on October 19, 2021 after the incident.
