Consent within Nikah ...

Assalam o Akaikum! I have a question and I (24 M) would like to hear Islamic rulings as well as from a female point of view.

I had my nikah early this year. We had been engaged for a few months prior to that but there was tension and disagreement between us. She is from "back home" and very conservative. I take my deen very seriously but I live in the US and we often can not follow our deen the way some Muslims would do back home and that caused a rift.

After a few disagreements, I wanted to back out of this marriage and told my parents. They told me that she will adjust. To be honest, I did not want to pursue this marriage as at that time I felt like she was not the one for me and we were not compatible but I came under parental pressure. Then we had our nikah and our relationship began on a very cold note. It is not that we were fighting but we would start conversations, disagree and then become silent and distant. There was a lot of silence in our marriage with me being on the computer and her just doing her things in the house avoiding me and not talking much. You may call it a cold war.

Prior to my marriage, I had stayed away from haram as much as I could and never dated and avoided being mixed gatherings as much as I could. This was my first time in the presence of a woman and when pardah came off, I was secretly very attracted to her. I say secretly because we were in a cold war. If we had a good relationship like a normal couple, I would have sat her down and told her my feelings that our differences aside, she was so very beautiful. But due to the cold war and silent treatment we were giving each other, there was no environment for that conversation.

Now, a few months into our marriage, I am very much in need of her. She is still very distant and rejectful. She wants to stay up and read and only when I am asleep she joins in bed. This is done purposely to avoid me. It is odd to be in bed with someone you are in disagreement with. It is not that we have not been intimate but it is not as frequent as I want it and she does not open up much.

Firstly, celibacy is already hard on people but it is even harder if you have a woman without pardah in the house that you can look at but can not touch. It is not a healthy situation to be in. Part of me says, I have her in my nikah and I can just take her whenever I feel like. I am obviously stronger and I can get what I want. But there is conflicting opinion on the internet even among religious people. Some have said that even within marriage, consent should be obtained. Some people have said that it is not zina since she is in my nikah but it would be against the ADAAB of the bedroom.

If it is only a compromise of bedroom etiquette, then I do not care. But if there is an Islamic ruling that prevents a man from taking a woman who is in nikah because she is not talking to him then I will never dare do anything like that.

I would appreciate it if people more knowledgeable in Islam could elaborate on this. If there are any sisters reading this, specially those already married then your views would be greatly valued. May Allah bless those who offer their help inshAllah.

Many of you are probably already aware of how creepy they are but here is a reminder to never trust male OB/GYNs. Are we supposed to pretend a man who has gone through the effort it takes to become a doctor and choosing that field out of all the other options is not suspicious?

Very telling about moid nature that this is an actual phenomenon... Whenever they are given the opportunity to abuse their power, they do. "Fertility fraud is when a fertility doctor fails to obtain consent from a patient before inseminating her with his own sperm." For example:
  • Quincy Fortier, a fertility specialist in Las Vegas, Nevada, in the early 1960s, impregnated female patients with his own sperm leading to 26 children during his 40-year practice. He died in 2006, aged 94 and the story was uncovered only in 2018 when a woman used a home DNA test to celebrate her retirement. The HBO documentary Baby God aired in 2020 was based on the story of Fortier and his decades-long fertility fraud scheme.
You'll see that many of these scrotes who are supposed to be highly educated ignored the possibility of DNA tests outing them in the future, or maybe their narcissistic urges to exploit women who are going through fertility issues were so overwhelming that they did not care. These procedures are both physically and mentally difficult for women. After enduring all that and finally conceiving, the last thing you want to hear is that your doctor lied to you about whose sperm he used and it was his own. Most people who find out are obviously horrified and sue them. If they said they wanted an anonymous donor, it was for a reason after all.

  • Cecil Jacobson, a fertility doctor in the 1980s in Virginia, was originally found to be the biological father of at least seven of his patients' children, including one patient who was supposed to have been inseminated with sperm provided by her husband. DNA tests have since linked Jacobson to at least 15 such children, and it has been suspected that he fathered as many as 75 children by impregnating patients with his own sperm.
  • In 2018, a woman in Washington State filed suit in U.S. District Court in Idaho against Gerald Mortimer, who was her mother's fertility doctor when her parents resided in Idaho Falls. After having difficulty becoming pregnant, her mother sought help from Mortimer and eventually became pregnant in 1980. The connection to Mortimer was hidden for 37 years until it was finally revealed when the now adult daughter used a DNA kit which returned the connection to Mortimer as her biological father, who had used his own sperm rather than an anonymous donor as agreed.
  • Donald Cline used his own sperm in his fertility practice in Indianapolis between 1974 and 1987 to covertly father at least 94 offspring. This came to light in 2014, when home DNA test kits were proliferating, and led to the discovery of Cline having used his own sperm to fertilize his patients' eggs. Because there was no law concerning the practice in Indiana, he was charged with obstruction of justice, false advertising, and immoral conduct, and lost his license to practice medicine. Cline pleaded guilty to two Level 6 felony counts of obstruction of justice and received a one-year suspended sentence. The first law in the United States came into effect in 2019 in the state of Indiana as a result of this case. As of May 2022, Cline has paid over $1.35 million to settle three lawsuits, with three more pending.
  • John Boyd Coates III, a Vermont fertility doctor, has had two lawsuits filed against him and has been charged with using his own sperm in cases going back 40 years. His license has since been revoked and a $5.25 million judgment in damages was awarded to the first plaintiff.
  • Jos Beek, a gynecologist in the Netherlands, conceived 21 children and potentially dozens more using his own sperm after prospective parents turned to him for fertility treatment, an investigation has discovered. He worked at Elisabeth hospital in Leiderdorp, now part of Alrijne hospital, between 1973 and 1998. He died in 2019.
  • In September 2020, a San Diego woman sued Dr. Phillip M. Milgram for having used his own sperm to inseminate her three decades earlier, instead of anonymous donor sperm. The deception was discovered when her adult son found that Milgram was his biological father after using a home DNA test kit from 23andMe.
  • In November 2020, a northern California woman sued her former fertility doctor Michael Kiken for having falsely inseminated her with his own sperm forty years prior. She bore two children, but only learned in 2019 from a DNA test kit that her daughter had received as a gift showed that her former fertility doctor is her children's biological father. In addition, her children may have inherited a genetic disease passed on by Kiken.
  • Jan Karbaat, a fertility doctor in the Netherlands, fathered 90 confirmed children and may have as many as 200 children. He died in 2017.
  • In 2021, Norman Barwin, an Ottawa fertility doctor, paid out a settlement of $13.375 million to his seventeen children conceived in his clinic in Canada in the 1980s. A total of 244 former patients and their children, including the seventeen conceived using his own sperm, are among the claimants.
  • In April 2022, a Colorado jury awarded $8.75 million to the families of a dozen women who became pregnant while being treated for infertility using artificial insemination techniques by doctor Paul Brennan Jones of Grand Junction who used his own sperm while the women were his patients in the 1980s. The jury found Jones liable for negligence, fraud, and other claims.
  • Fertility doctor Burton Caldwell created at least 22 children using his own sperm. Two of his offspring, both the result of insemination fraud, dated in high school, which is the first verified case of accidental half-siblings incest occurring as a consequence of insemination fraud. It has long been theorized that a large number of people with unrecognized very close genetic relationships living in the same community could result in accidental incest.

These are only some examples that happen to be discovered so the actual number of fertility fraud must be even higher. There is also the other side of this coin. "Serial sperm donors", the scrotes who have an obsession with becoming Genghis Khan. Here is a list of people who have the highest number of children. The aforementioned emperor tops the list that includes various leaders or men of similarly high status all around the world who had harems (also known as sexual slavery) which made them able to reproduce so many times.

The rest are mostly sperm donors who carried out unregistered donations, because actual clinics tend to have a limit on how many children one man is allowed to father. Maybe some men donate once or twice out of the genuine kindness of their heart because they are such altruistic, generous guys :optimistic: but the ones who did it HUNDREDS of times? It has to be a fucked up fetish for all of these moids, really. They don't give a fuck about the offspring or women, they have a god complex.

can’t remember where I read this but apparently a number of male gynos admitted to administering pap smears and mammograms to women they thought were attractive even if they didn’t need them. I read in the med school subreddits that a lot of male gynecology students are known for being creeps. You couldn’t pay me to go to a male obgyn.

I had to once because he was a specialist I was referred to by my usual obgyn and it was during Covid and he was so mean to me about being unvaxxed that I cried on the way home. He told me I would likely die alone at the hospital with nobody wanting to care for me because I was unvaxxed. He asked what I do for a living and when I told him my major at University he said something like "Oh, shouldn't you be smarter then? I guess statistics aren't your thing." Mind you I was there for a terrifying health scare that already had me really emotionally vulnerable (turned out everything was fine but I didn't know that at the time). It was the worst experience I ever had with any doctor. Really validated my decision to always chose a woman doctor.
 
When I was younger and went to male doctors I got invasive questions about my sex life and “where do you meet men?” (Nothing to do with my health, obviously.) Weird comments about how I’m “dressed like it’s hot out.”

Um yeah I stick to women professionals unless absolutely necessary.

Horror stories about male doctors make me so glad that the only male doctors I had growing up were psychiatric/behavioral.
Side note, for some reason while remembering a male behavioral counselor I had as a young child, how he spoke to me back then just rubs me makes me uncomfortable/unnerved remembering it. I don't know how to put it, just that vague memories of how he spoke and remembering his face makes me uncomfortable.
For context, I had behavioral issues and I had to see him either monthly/weekly (can't remember which considering how old I was). I can't remember most of the sessions I had with him, which I consider unusual considering I remember most of the others I saw, even if it's a vague memory here or there.

There are worse than useless women in social services and healthcare as well, but I just thank God things weren’t worse for me than they already were. You cannot trust men to not jack off into houseplants. Letting them have unsupervised access to vulnerable people and children? Why do we let men become doctors/go to school/go outside again?
