More than 200 jurists have submitted an open letter with the demand to initiate an AfD ban procedure to members of federal parliament and the federal government. According to their assessment, all requirements for that are fulfilled.

Ultimately, the Federal Constitutional Court would need to decide on a prohibition of the AfD.

Further preparatory examinations are not needed, they say. The representatives need to finally live up to their responsibility, initiator Felix Dengler from the Republican Lawyer Association (RAV). In November, in a legal scientific assessment to the federal parliament, 17 constitutional lawyers have assured that a corresponding petition to the Constitutional Court would likely be successful.

A prohibition of a political party can be petitioned for by the federal parliament, Federal Council, or federal government at the Federal Constitutional Court. In the middle of November, a group of more than 100 members of federal parliament from several parties have presented a petition. Whether it's likely to reach a majority is open. Federal chancellor Scholz has recently spoken against an AfD ban procedure at the current time. He and other critics warn that a procedure would be very time-consuming and the outcome would be open-ended. In addition, there are worries about prohibiting a party with high voter approval.
 
Germany and Europe as a whole are just totally fucked by authoritarianism.
Most European countries are already in soft dictatprships at best. Best one can hope for is to die before shit gets really bad but I have very low expectations for the continent as a whole in the coming years. Well, that or full chimpout with luiginomics applied.
 
This is despotic anti-democratic authoritarianism by any other name. It is beyond corruption at this point. It is a multi party dictatorship, simple as that. No use calling it anything but. Not just the parties but the system as a whole. The fact that it was setup as is expressly to disenfranchise people the elites don't like, and done so openly, as a feature.. is proof enough of that.

Why does much of europe fail so hard with freedom and democracy?

Ironically, I've seen some black-white-reds applaud the AfD on social media... so I'm totally confused.
I've seen some black-white-reds promote the Taurus Leaks, which also seemed to be popular among the AfD fans. The same black-white-reds want the GDR to return.
Unless the black-white-reds are looking for a "collapse", as do many of the Luciferian/Satanist types, so the "Golden Age of Lucifer", complete with eugenics and transhumanist robots, can take hold.
Same black-white-reds are very vague about whether they are white nationalists or commies, or both, so... who knows.
 
A color revolution is what will happen if AfD somehow wins.
Only if the United States govt is backing it against an U.S. ally or aligned nation. As that's what the Obama administration had done all along north Africa and the Middle East.
 
They tried to ban the NPD (proper neo nazis) back in the day and they failed, they're still around just under a new name. Banning a party that, according to polls would get 20%+ in the next election would be anything but democratic: they would essentially declare the choice of the millions of voters illegitimate.

Not that it would help the other parties, mind you: they're not going to get those people to vote for left wing parties again.

This is how postwar germany has always dealt with any political unrest or threat to the political status quo. They simply ban the opposition and present the voters with a choice between things that are ultimately the same.

This situation is slightly different because this time the governing oligarchy in Germany has utterly failed and is leading the entire country into an economic abyss with a good probability of systemic collapse.

What happens if AfD just disbands and rebrands with another name?

It takes time to create and organize a new party. The belief among the oligarchy is that a ban will allow them to survive the next set of elections and their thinking is so short-term now that they have no plan beyond that.
