I frankly think judges should avoid thinking about "spirits" and shit, "penumbras" and "emanations" and that kind of nonsense (that is literally from a Supreme Court decision). They should base their decisions on the law as it actually is, not just make up shit to justify their own morality. The only place thinking about the "spirit" of something comes into play is if the language itself is ambiguous. Otherwise, judges are bound by the law. The law is not bound by judges, or at least shouldn't be.
