In fairness to them, Pho adding the "transformative dancing gunt" and what-not probably does not pass the fair use test, if only because there's no actual commentary. It is playing Ralph's content wholesale with no commentary present. As such this is probably a good call from a legal standpoint, and I think the law would back Odysee up in this case. That being said, if Odysee decided, on it's own, that they would remove it without conforming to what is required under the DMCA, then they likely would be giving up Section 230 protections because they made an editorial decision. If Pho has no recourse--or his recourse has to include them--then Odysee could theoretically be named as a defendant in a lawsuit filed by Pho.

It's supposed to be "Notification > Counternotification > Lawsuit" under the DMCA. That means Ralph files the notification, including all relevant personal informaion; Pho then files his own counternotification, complete with his own information (and yes, this includes legal name and address where he can be served legal paperowkr--a PO Box works fine for this); then, Ralph has 14 days to either drop the claim, or file a lawsuit. Obviously, Ralph would do what he did with @Null previously and just let it lapse at the endo f the 14 days in order to fuck with him. At the end of that 14 days, if Ralph has not filed the lawsuit then Odysee would be required to reinstitute anything they took down.

What Tea Clips andd other clipping channels do is 100% fair use. Ralph knows this. Gator knows this. Since each clip is transformative in nature simply for be a fucking clip then they would easily pass scrutiny of the fair use. Ralph would lose, and he knows this. That's why his response is people can sue him if they don't like it. Except that's not how it works, the fat, overused prison fucktoy simply doesn't have the money to file a lawsuit, let along fucking win it. File your counternotifications, use a PO Box (it's like $50/month, people) and put the ball back in the fat faggot's court.

it depends, its just as transformative, actually far more so than nearly any instance of ralph's copyright theft. legally maybe dunno how lax it is, morally if ralph wasnt a massive hypocrite then people just wouldnt be doing it anyway. if ralph has a right on odysee to play tucker clips in full with little to nothing in the way of commentary or editing, just watching tucker uploads then something that alters the visuals and audio heavily like pho's streams should be allowed or he and ralph should be banned together.
