Will we ever see or hear from Chris again?

That's a good question, but most likely probably. While Chris is resilient to a lot of stuff that would drive a normal person insane, he also possesses the ability to get really scarred by events. It could be after six months of his worst fear since childhood, being put in the boobie hatch, getting ridden everyday for those months, might make a difference. I could see him getting "broken" in a way that really throws his delusions to the wind and getting a regimented mindset of what the real world expects of him.

That's not to say he won't go back to how it was before, but if he's frightened of the current situation, gets a basic tard regime drilled into his skull, and forced to live like that for six months, there might be some progress made. As some people have said, Chris has never gotten positive reinforcement for things he's done right, but a place like where he allegedly is will include that. Chris being rewarded for doing what he's told in a measured, calculated way, may be the key.

Or he'll just go completely out of his mind at a McDonalds as soon as he's let out after eating half the menu.

He was fired from wendy's, I guess you can't go any lower than 40+ year old McDonalds fry cook. (nothing against McDonalds employees, I have worked there as well, was a great experience, I learned to never work for a fast food chain again) I doubt he would last, fucking up simple things , refusing to put pickles on anything because pickles, and probably eating half the bag of bacon.

Apparently he got over his aversion to pickles, Bella gave him pickle rick candies and Chris appreciated the gift. He also adds pickles to his Chili dogs.

That's actually similar to my initial take on it, that they are both equally at fault. Definitely sounds like, especially by what you've said.
I'm not saying that is the case, I'm saying we don't know for sure. I'm still leaning towards that him raping Barb, although anything is possible.

A news article I read said in Virginia he could receive a sentence of up to 10 years for incest but I agree, with his autism he’d probably have gotten the minimum sentence.

Yes, he can get up to 10 years if he's indicted and convicted on a felony incest charge. It's been 7 months and there is no indictment. Normally an indictment would have happened by now, but it's possible they're holding back on it. Basically one of three things is going to happen at his next hearing. He goes back to the mental hospital, he gets a plea deal, or they indict him. They could also let him go and indict him later but that is extremely unlikely and I can't see why they'd do that.

If they try to hold him longer without indictment, and without him being in a mental hospital, he could voluntarily stay in jail longer without an indictment, but the one year mark is where his attorney can basically tell the prosecutor to take the plea deal now and shit or get off the pot. Spending more than a year in jail without indictment wouldn't have much benefit for Chris.

The only reason I could think of holding it off longer would be to earn tugboat time.

There are some states where time in a mental hospital doesn't count as time served, but Virginia is not one of them. At the next hearing Chris will have built up a year of time served.

Pretty sure that's for felony incest, and incest in Virginia can be considered a felony or not on a case by case basis.

Currently Chris has still not been charged with a felony, his current charge has a maximum penalty of a year I think.

It's a little more nuanced with that. He's charged with something that *can* be a felony, but he's not indicted on it. It's sort of in a quasi-felony state. This means that he can be immediately convicted on a misdemeanor, but can't be convicted on a felony until he's indicted. Whether or not it's a felony is up to the prosecutor, and at the one year mark they basically have to decide if it's a misdemeanor or not, if Chris' attorney demands that they make up their mind.

If it's a misdemeanor, they have to let him go. If it's a felony they have to indict him. Unless Chris' attorney decides that Chris should willingly stay incarcerated in the hopes that they change their mind and make it a misdemeanor, but that's sort of admitting weakness to the prosecutor and then the prosecutor has every incentive to just let Chris stay in jail as long as he's willing to, until they reach 10 years (at which point they have to let him go no matter what unless they decide to charge him with rape).

In normal circumstances, felony charges would be a much bigger burden on the prosecutor's office, so the incentive is for the defense to say "Hey, take the easy misdemeanor conviction, my client has already spent the full sentence in jail. If you don't, I'll make you go through the trouble to do the felony paperwork, and then I'll fight you every step of the way, except it will be a bigger pain in the ass for you than it is now."
In Virginia, legally, the difference between a felony and misdemeanor is whether you can be sent to prison or not. You can't be sent to prison for a sentence of under a year.

The indictment doesn't have to actually happen on the one year anniversary. If the prosecution just *asks* for the probable cause hearing (thus declaring that they're seeking felony charges), then Chris can be forced to stay in jail without bail. For all we know the next hearing could be a probable cause hearing, though it probably isn't and is more likely just a competency review.

If they really wanted to indict Chris no matter what, they could drop the case in J&DR and go for a direct indictment. The standards for that are stricter, but really, grand juries will still mostly rubber stamp it as long as everything checks out. The prosecution would only go to that effort if they were dead set on nailing Chris on a felony.

Of course Chris can just keep going back to the state hospital every 6 months forever until he's deemed competent or unrestorable, and the probable cause hearing never happens.

I assume a lot of that depends on if Barb will/has thrown him under the bus or not. I don't know the general assumption right now but I figured she hasn't even if she has cut contact, or the charges would've already changed. There's nothing really stopping her from just saying "fuck it" and distancing herself via family encouragement. No doubt Chris will try to show up to 14BC no matter what whenever he is eventually out, but he can get slapped with a trespassing charge either way (restraining order or Barb just wanting nothing to do with him) and the cycle will repeat— Time locked up, try to go to 14BC, more time.

I have seen some say though upon release he likely won't be very close to 14BC and while he will try, he wouldn't reach the property successfully on his own. No car, no understanding of public transport, and he's lazy as hell. This seems like a safe bet.

Sonichu was Chris righting the "wrongs" in his life. As he got older, the wrongs became much less interesting. He eventually found a bunch of people who were more "r-worded" than him and settled into a happy life with imaginary spouses, tranny kids, and over fifties gf who was also his mother who is suffering with cognitive decline.

That has no strict legal impact on whether it's a felony or a misdemeanor. Whether it's a felony or misdemeanor is entirely up to the prosecutor and the court. The prosecutor could decide to fine Chris $1 and give him no jail time (even though he's been in jail for 7 months already) and call it good. The judge could overrule this and give him the max misdemeanor sentence, but it's still up to the prosecutor if it stays in J&DR or goes to Circuit.

Even if the prosecutor asked for a felony and it went to Circuit Court, the jury (at a jury trial) or the judge (at a bench trial) could decide to downgrade it to a misdemeanor, no matter how many times it happened.

There's no law that says "if he did it 6 times then it's a felony".

There is a mandatory sentence statute if he's convicted a second time on a felony for oral/anal sex with Barb -- after he's been in prison for the first charge -- then he gets the maximum 10 year sentence. Even for that though, it has to be a felony conviction both times. If either of the two is convicted as a misdemeanor, then it doesn't count.

The only two charges that Chris could potentially face that are hard felonies no matter what is rape, or the "healing arts" offense. The "healing arts" one would be slightly easier to prove, as that one requires affirmative consent. The rape charge requires proving that Barb said "no" when it happened. The "healing arts" charge would require proving that Chris told Barb he was "healing" her, and that Barb never said "yes".

If Chris spends a year on a misdemeanor, or 3 years on a felony (a realistic sentence for a first felony conviction if the max is 10 years), or even 5 years, would he really learn anything different? I doubt Chris even understands the difference between a misdemeanor and a felony, since in CWCville besmirching Chris' name earns you the death penalty.

No matter how long his spends in jail, or if he goes to the nut house whatever happens Chris will learn absolutely nothing.

Chris believes cartoons are real. He will never abandon that belief. If anything he will be put on anti psychotic medication and claim that since he was in jail and couldn't wear the medallion nothing he said or did was true or honest.
