You have to eventually. The presumption of damages in defamation per se is relevant when facing a motion to dismiss. You don't have to prove damages at that point. You do eventually have to prove damages to collect. So, for instance, when Elon Musk called that caver a "pedo guy," this was presumed defamatory, but he ultimately won the case after it went to trial.Accusing somebody of hosting CSAM is defamation per se. You don't have to show damages in a defamation per se suit.
It is always ultimately about money. Anyone who thinks courts are about justice is cruising for a bruising. It's not about the money, it's about sending a message.
There's calling someone fat or a faggot, then there's accusing someone of something heinous, like being a purveyor of pedo porn. This site ls literally made to make fun of people who sue for that.
Yes it has. Again, and again and again from many different angles. You're right. it's just that all the discussion has been centered on damages and fucking with Epik themselves that the peripheral consequences that are the really important ones hadn't been discussed much in the thread.
Whole thread: https://ghostarchive.org/archive/xRgYQYeah, this is why we have to sue.
Hahahahahaha. Yea, that's never going to happen. Null could win a case at the Supreme Court and it wouldn't be mentioned in Wikipedia.I need to see on the Wikipedia page that Epik lost a court case accusing the Kiwifarms of hosting child porn so I can point to it whenever people start sperging about the site.
Consider adding a progress counter too that you can update daily or weekly as needed. There's a reason why all crowd-funding sites do it. People will be more hesitant to donate (or donate their full intended amount) if they think the total won't be met and that their money will just be wasted instead. It's going to be very simple and basically just a payment mechanism.
It won't be wasted regardless. I've footed the bills for lawsuits out of merch money for years, there's ongoing litigation even if we don't sue, and there will be a perpetual need for a defense fund moving forward.Consider adding a progress counter too that you can update daily or weekly as needed. There's plenty of other good reasons to do it too and should be simple enough to add and update manually.
You can use nitter.poast.org or nitter.privacydev.net to archive whole twitter threads with archive.is.There are alot of Tweets and Ghost is choosy when in wants to work or save whole thread.
I just tried again with ghost and it seems to save the whole thread when you save the Twitter.com/... vs X.com....You can use nitter.poast.org or nitter.privacydev.net to archive whole twitter threads with archive.is.
Just curious, how secure will the site be? I can already envision seething trannies trying to get card info and DDoS-ing the site.
I'm working on the site now. It's going to be very simple and basically just a payment mechanism.
