I don't think anybody has doubted that Solo committed a crime by releasing it. Destiny will only get in trouble if he told people they can publish or share it. Publishing with malicious intent is one of the core elements to count as revenge porn. But nobody is getting sued it's probably not possible to link Solo to a real identity, if he was careful.
