The Twitch DMCA Saga (Three Times Resilient!)

But this is the problem with trying to have a discussion about what Phil and does not deserve, isn't it? Difference in perspectives. I'm not in the camp that the pigroach has gotten "massively lucky". I can't in good conscience see things that way because as I've said here on the Farms before, no one would trade places with him. They would take the luck they think they see him benefiting from, but that's not an option when we're talking about so-called "pigroach luck". What normal people want is to get lucky and win the Lottery, not get lucky and survive what Phil has put himself through. "Survive" being used pretty loosely here, because good lord is his future fucked one way or another.

I don't want to get this to be too power levelly, but like I grew up in a poor area. There are people who are drowning in medical debts. Those who don't really even have the option for bankruptcy. Or people have to stretch paychecks day to day. Begging on the phone with the electric company to please please please take the 10 dollars they have in their account and don't shut off the lights. Telling their landlords that they have been putting out apps, they got a couple interviews tomorrow, I'll have all of your rent soon, please. These are people who have a pretty fucked future. They can't turn to the internet and cry poor. And get 200 minimum a day. Phil has that avenue. That's luck. He didn't get there on hard work. He got noticed by the Youtube machines and promoted and got a fanbase. So now if he overdrafts his account, and I fucking doubt that actually happens he can turn on a stream and get free money. Do you have that option? I sure as fuck don't. I don't know anyone who does personally. That is lucky. That's almost better than winning the lottery. He has an actual fucking money tree.

And in case if someone wants to bring up bad life choices as an argument for my first paragraph. Lets not forget we are talking about Darksyde "$40k in a gacha game" Phil. The man can make bad decisions all day long and then turn around and fix them. Sure it's at the cost of his happiness. And honestly that makes me even madder about it. Because once again. The man has an actual money tree. Because it's not like he does anything for the vest goal. People don't pay him $100 everytime he finishes a game or a level or has a good K/D ratio. He gets the money for being there. To barely play video games. And considering how often we see him just take giant breaks or look at his phone or fall asleep. Honestly a money tree would be more work because he'd have to go outside and reach up and grab it. He sits on his couch and gets handed money. And he's ungrateful for it. But he's still lucky. And so this is what he deserves. Honestly, it's the best possible ending I could envision for him. Getting fucked by the loopholes and technicalities he's so often exploited. If he had a goddamn inch of self awareness he'd be believing in a higher power right about now.

- says he requested to get a new partner manager, since the other "guy" doesn't seem to be working for Twitch anymore
- admits he's breaking Twitch's ToS about not streaming on another platform while being partnered
- "Twitched fucked me over, so why would I care about their rules!?"
- "I want the Twitch situation resolved, but I'm not sure if that's going to happen; the update is not a very good update"
- says it looks like he'll be able to stream on Twitch again later today
- "I don't care about Twitch saying I can't stream anywhere else"
- "If I get kicked out of the Partner Program, then fuck it, I don't care"
- calls the DMCA claimer an "asshole"
- keeps stalling on telling what "the update" is about. Received $85 in about 33 minutes of talking on stream.
- Twitch's response to DSP's request to provide him info about what was claimed so he could file a counter-claim is an auto-response, and his ticket has been closed and marked as being 'resolved'
- "They didn't read it again!"
- an email from Twitch says the DMCA claim from Sunday was done on the "x 7 subscriber badge"
- the DMCA claimer has made a (in DSP's words) "bullshit page that acts like they created the badges in 2015". Then shows it on his phone to prevent his home IP being tracked:

- Twitch's email says his Twitch account will be terminated when he gets a third strike



Wait... I'm seeing a different Twitch channel there. Could it be that Popsicolo, who created DSP's sub badges, actually (partially) used someone else's work? :story:


It's one thing to get fucked by a flawed DMCA system/law, but it's a whole different thing to actually make it worse it by letting yourself go like this. Not really a mature adult way of handling this.
My takeaway from this is he's not only proving someone scabbed something from someone else but he once again showed something on his phone after saying he can't show anything from his phone eg. his wwe champions account that's allegedly been dormant

As far as I can tell at this point, the DMCA claimer found out that DSP's sub badges were created by someone else in August of 2015 as part of a commission (misspelled "comission" btw) for a Twitch channel ("barbaro"-something). I can't read the actual website address, [something].blogspot.com. If this is true, then the DMCA claim could actually be legitimate, and Twitch has no other option than to honor the claims (I think? Paging Dr. @Null).

So basically, Dave's unwillingness to invest anything into his streams bit him in the ass with one of his dumbass followers stealing shit for him.

It's hilarious how literally every single time Phil talks shit about someone, money is always, without fail, at the forefront of his mind.

And so on. He doesn't try to hide his greed at all.

I find myself asking how is it you kiwis can get a snapshot of that zenith of the pigroach at his ugliest and then I realize that's every single moment he's on camera you don't exactly have to go frame by frame to find it you just click save timestamp as image. To quote Moe from the Simpsons when Ned said he was an ugly, hate filled man. "Hey I might be ugly and hate filled but I'm....uh what was that third thing again?"
