SNP outlines proposal to ban 'conversion therapy' after its self-ID law was blocked by UK Government

Parents who refuse to allow their children to change gender would face up to seven years in jail under SNP plans to ban “conversion therapy”.

Proposals published on Tuesday state that actions designed to “change or suppress” another individual’s gender identity, causing them physical or psychological harm, would become illegal under the radical law.

SNP ministers acknowledged that so-called conversion practices often took place in a “family setting”, raising the prospect that parents could be criminalised if they refuse to go along with their child’s declaration that they are transgender.

Stopping someone from “dressing in a way that reflects their sexual orientation or gender identity” was put forward as an example of an action that would become illegal, even if a parent believed they were acting in a child’s best interests.

A consultation states that alongside new criminal sanctions, preemptive civil orders could be obtained against parents or religious leaders, even where conversion practices had not yet taken place.

The plans are the latest controversial measure put forward by the SNP. Critics argue the proposals would have a devastating impact on freedom of speech, privacy and family life in Scotland.

Last year plans by Nicola Sturgeon to allow children as young as 16 to change gender were blocked by the UK Government.

Religious campaigners have vowed to fight the ban in the courts.

“We have grave concerns that these plans will criminalise loving parents, who could face years in jail simply for refusing to sign up to the gender ideology cult,” Marion Calder, a director at the campaign group For Women Scotland, said.

“They will also hand activists and social workers unprecedented powers to meddle in family life, while having a chilling impact on therapists and counsellors.

“If the SNP and Greens insist on pushing this through, it is likely to go the same way as the toxic self-ID and named person laws and be blocked in the courts.”

Discredited practices​

The measures around gender identity also include far less controversial steps to outlawing discredited practices that aim to turn gay people straight.

Providers of services aimed at suppressing or changing a person’s sexual orientation or gender would be targeted, with taking someone out of Scotland to access “conversion” services also to become illegal.

A consultation stated that parents or religious leaders would not be criminalised for “expressing concerns”, “advising a child against medical interventions” or “not actively supporting” a child’s decision to dress as a member of the opposite sex.

However, it stated that when actions became “coercive” or “controlling” then the law would apply, even in cases where they were motivated by “a desire to help or protect the person”.

Those accused of conversion therapy would have a legal defence if they could show their actions were “reasonable”.

However, this would apply only in “a very small number of circumstances” such as to prevent a child “from engaging in illegal or dangerous behaviour”.

Anyone breaching a civil order, which could be obtained by social workers or activist groups on behalf of alleged victims, could face two years behind bars.

The maximum penalty for those guilty of a criminal offence would be seven years in jail, an unlimited fine, or both.

The SNP has chosen to push ahead with the law despite the damage inflicted on the party by Nicola Sturgeon’s controversial gender self-ID law, which was blocked by the UK Government.

A planned conversion therapy ban in England has been shelved by Rishi Sunak amid internal disagreement over what would be covered.

A spokesman for the Catholic Church said it had “serious concerns” over the Scottish proposals, claiming they “may criminalise advice or opinion given in good faith”.

Care for Scotland, a Christian charity, warned the measures “could lead to the subjective policing of speech about sexuality and gender, in a range of settings”.

Michael Veitch, the group’s policy officer, said: “Ultimately, parents, teachers, church leaders, counsellors and others could be caught up and unfairly criminalised.”

‘Destructive’​

However, Emma Roddick, the SNP equalities minister, said attempts to change or suppress a person’s gender identity or sexual orientation were “damaging and destructive” violations of human rights.

She added: “The consultation responses we receive will help us to further consider those measures we can take to stop the harm of conversion practices and protect those at risk while ensuring that freedoms – including freedoms of speech, religion, and belief – are safeguarded.”

Maggie Chapman, equality spokesman for the Scottish Greens, backed the planned law, which the SNP agreed to implement as part of its coalition pact with her party.

“Conversion practices are not therapy,” she said. “They are abusive and coercive. They are a form of violence that has no place in a modern or progressive Scotland.

“Nobody should be told there is something wrong with them or be forced to be ashamed of who they are, just because of their identity.”

Here is why I think the troons are jumping the shark on the Supreme Court turing down the troon bathroom case. A troon child is a necesary precondition for a troon school bathroom dispute. There are numerous childhood troon bans pending before the court. If the court accepts one of those cases and finds that there is no protected right at issue with childhood troon bans, then the bathroom cases resolve themselves as second order effects.

I looked into it, and the bill doesn't just ban "affirmative" drugs and surgery, it bans the affirmative (lit. grooming) model of mental therapy.

Has Ohio always been this based? This is the proper approach to dealing with tranny nonsense.

It always seems like the progressives are constantly ahead of the curve and laying foundations for whatever horrible shit they want to push five years from now, and conservatives are often running damage control and playing catchup. This directly counters the frontier attempting to be normalized by troons. This just states "No, treating your male children as boys and your female children as girls is under no circumstances 'child abuse' and we are protecting normal people from being villified for it, before this becomes the norm."

Troon refuge bills are all unconstititonal on their face because they violate the full faith and credit clause of the US Constitution. Of course Tony would never mention such an inconvenient fact.

I’ve seen now a few times where some normies make very milquetoast “hey if they’re doing this to kids that’s messed up”-type statements in a video game or pop media subreddit when the subject is brought up (often by a tranny loudly crowing about how great it is) and ofc they immediately get ripped to shreds/their comments locked/deleted; even when they don’t win by the numbers, I can only hope they and other lurkers are peaked by such behavior. It was quite funny when the Hogwarts game first came out and all the blissfully unaware HP fans were getting told they were evil Nazi transphobes committing literal genocide for wanting to play the wizard game.

I’ve had the same experience with YouTube and article comments, which is heartening.

I live in an ultra, ULTRA blue state & town and even (formerly?) lifetime-Democrat families in my circle are pulling their kids from public school in favor of homeschooling, and the cause they have universally cited as their reason for doing so has been "the trans stuff". I'm inclined to believe that it really is that unpopular, and that's great news. Child transitioning is objectively evil, and I hope more parents take a scorched earth approach to protecting their kids.

The organization must make million-dollar budget cuts in the form of layoffs due to its “financial crisis,” according to the New York Post. The members asked the DSA’s board of directors to reduce the organization’s staff-related expenses by $500,000. The DSA would initially ask employees to surrender their jobs.

“We will first ask for volunteers from both director-level and bargaining unit staff to have their position cut and receive severance,” the members wrote, according to the New York Post. “If necessary, we will then explore initiating lay-offs according to the DSA union’s contract.”

My condolences that you have to deal with the trannies fleeing Texas, Ohio, Tennessee, and Kentucky to get their unobtroonium. What are the chances you get a similar law passed via ballot initiative?

That's the real red line. It's all fun and "how does that affect you, personally???" games until their child talks about ending their family line. This is a core human instinct and not even the most heckin' validest of allies and yesmen can escape it. You tell almost anyone that their kids have a legal right to self-sterilize (and that not playing along is literal "child abuse") and they'll peak, whether privately or publicly.

I think that what we can say is that for minors, they are not capable of giving informed consent... We already regulate what minors can do. They cannot sign contracts, buy cigarettes, consume alcohol, they can’t get a tattoo without their parents. We already have rules concerning that. For minors the prefrontal cortex is not developed, in fact that's really not developed until the age of 24. I think there's something to be said for adults being able to weigh the pros and the cons. One of the things the governor did, he made several mistakes, but he actually put in some things I had to negotiate out. One of them is getting the data, there's no requirements to get the data. I had that in there, it got negotiated out... The other thing is planned parenthoods, they pass out hormones like candy, he's put a stop to that. That's one of the places a lot of adults will go. There's also Euphoria and Plume, where you can get your letters and hormones through an app. We need to slow down the game."

Rep Schriver: "When it comes to consenting... consenting to mutilation, consenting to self harm, consenting to killing yourself. There are a few people wanting adults to be able to consent to killing themselves legally like they do in Canada. When it comes to adults, I'm not saying anything in the way of dismissing what you're saying about children and puberty blockers, that's all very valid and necessary, I'm just saying moreover in addition to that, we have to be looking at the endgame simultaneously, maybe even using that to move the window to say that this isn't just wrong 0-18, it's wrong for everyone and we shouldn't be allowing that to happen."

Rep Click: "Reuters asked me one time when they said, do you feel bad because all of these states that are now blocking the procedures for children are having to close down their gender clinics and now adults can't get care? And I said no, I don't feel bad. We have to take one bite at a time, do it incrementally. When you put everything into one pot, it's going to be harder for you to get any legislation across the finish line."

Prisha Mosley: "I did want to say that I've kind of been waiting for a state or a representative or anyone to be brave enough to address that. I just wanted to throw out this is the angle I would go at it. It's easier to handle the kids because of how we handle consent. However, I also think people in grave mental distress or who are mentally ill cannot consent. Also telling a suicidal person either take this treatment or die by your own hands, you can't consent to that. And even take that away, you cannot consent to a lie. Most of these doctors are straight up lying about the effects and saying it'll magically cure every bad feelings you've ever had and that you can magically change sex"

Several Republican legislators from Michigan and Ohio were recorded in an online forum planning to try to ban trans health care for everyone, regardless of age.

The discussion was hosted by state Rep. Brad Paquette (R-Niles) on the X social media platform and included Reps. Josh Schriver (R-Oxford) and Tom Kunse (R-Clare) as well as state Sens. Lana Theis (R-Brighton) and Jonathan Lindsey (R-Coldwater). Also featured was Ohio state Rep. Gary Click, sponsor of that state’s ban on gender affirming care, and anti-trans activist Prisha Mosley of Michigan.

As first reported by independent journalist Erin Reed, the legislators openly discuss their opposition to the trans community, and more specifically to any kind of transgender care, even for adults.

“In terms of endgame, why are we allowing these practices for anyone?” said Schriver. “Why would we stop this for anyone under 18, but not apply this for anyone over 18? It’s harmful across the board, and I think that’s something that we need to take into consideration in terms of the endgame.”

Click, whose legislation would also prevent transgender athletes from playing women’s sports in Ohio, called Schriver’s comment a “very smart thought” and then added advice for Republican legislators seeking to outlaw gender affirming care.

“I think sometimes what we know legislatively is we have to take sometimes small bites,” said Click, who then lauded restrictions placed on transgender adult clinics by Ohio’s Republican Gov. Mike DeWine.

“The other thing is Planned Parenthoods. They pass out hormones like candy; he’s put a stop to that,” said Click “That’s one of the places a lot of adults go.”

DeWine had instituted the restrictions as an alternative when he vetoed Click’s bill. However, the Ohio legislature later overrode the veto, so as of April 23 that state will ban gender-affirming care for trans and nonbinary youth, including hormone blockers, hormone replacement therapy (HRT), medical or surgical procedures and some mental health services.

That’s despite major medical organizations that have all concluded age-appropriate gender-affirming care is evidence-based and medically necessary, including the American Academy of Pediatrics (AAP), the American Academy of Child and Adolescent Psychiatry and the Endocrine Society.

Additionally, the World Professional Association for Transgender Health (WPATH), an international organization of health professionals, has long stated that age should not be a barrier to providing care for those having gender identity issues.

“If there are persistent and strong indications that gender dysphoria is present, a comprehensive evaluation by clinicians skilled in the assessment and treatment of gender dysphoria is essential, irrespective of the patient’s age,” states the WPATH Standards of Care (SOC).

Schriver returned the conversation to finding a way to ban all gender affirming care, which he likened to “essentially consenting to mutilation, consenting to self-harm; consenting to killing yourself.”

“I’m just saying, moreover, in addition to that, we have to be looking at the endgame simultaneously,” he said. “Maybe even using that as a way to move the window and to say, ‘Hey, this isn’t just wrong for 0 to 18. This is wrong for everyone, and we should not be allowing this to happen.”

Click then relayed that he had been asked by reporters if he had any regrets that bans like his against gender affirming care for minors in Ohio also had the effect of closing down gender clinics that treated adults.

“No, I’m actually pretty happy about it,” he said. “I don’t think they ever printed what I said, but sometimes we just have to look at taking one bite at a time, doing it incrementally. When you put everything into one pot, it’s going to be harder for you to get any legislation across the finish line. So take off a bite-sized portion of it.”

Theis talked about legislation in Michigan she said was “trying to undermine” humanity, including the recently passed ban on conversion therapy, which she called “antithetical to their chromosomal true biology.”

That assertion is refuted by major health organizations like the American Psychiatric Association, which has opposed conversion therapy since 1998 and said in a statement on its website that, “gender diverse patients have been shown to benefit from gender-affirming therapies.”

Additionally, research from The Trevor Project and published in the American Journal of Public Health concluded LGBTQ youth who were put in conversion therapy were more than twice as likely to report having attempted suicide than their peers who had not been through conversion therapy.

Theis also repeated an often-used, though debunked, argument against Proposal 3, which passed overwhelmingly in 2022 and enshrined the right to an abortion in Michigan’s constitution.

“What that means is that these children can have abortive services or transition services without parental knowledge,” she said. “They’ve got three days to get it done, and we can show over and over and over again how it’s not necessary, that there’s even an interview that they just go ahead and give you permission to get hormonal therapy … cross-sex therapy. It’s horrific.”

Schriver again stated at the end of the discussion that when it comes to gender affirming care they should “ban this for all people.”

“We’ll chat offline about all this good stuff,” answered Paquette, who then offered thanks to Click, as well.

“Let’s be in touch, as well, if you don’t mind, so we can make sure that Michigan can follow Ohio’s lead,” he said.

All of the Michigan legislators involved in the call were asked by the Michigan Advance to comment, but so far none have responded.

However, Democrats and other progressives have taken notice.


State Sen. Mallory McMorrow (D-Royal Oak) posted to social media a link to the conversation, and noted that former Republican gubernatorial nominee Tudor Dixon “and the entire culture war slate of the GOP lost in stunning fashion because they would rather attack kids than focus on issues like affordable housing.”

Meanwhile, Sam Inglot, executive director of Progress Michigan, also issued a statement about the conversation.

“The lengths to which Republican lawmakers have been willing to go publicly in their campaign to demonize, victimize, and isolate trans people are already despicable, but the comments made on this call go even further,” he said. “Gone are the flimsy and veiled comments—now, they’re admitting to their real intention: stripping away trans people’s fundamental right to pursue the care that’s right for them.”

Inglot said the discussion provided proof that the GOP’s opposition to trans health care was not about the procedures themselves.

“It’s about the hate, bigotry and cruelty that drives right-wing extremists, to the point where they would rather see trans people suffer than simply let them exist,” said Inglot, who promised to “fight tooth and nail to protect their rights and lives.”
