Imagine getting mad that people have to stay late, and past midnight due to a technical error. There is no fucking job, anywhere in the world that continues past 5PM. Everything stops, literally fucking stops the moment quitting time hits. The only way Ty could keep his crew there was by keeping a gun in hand and letting them know the first one out of the door gets two in the back.

Becoming a notary is actually pretty simple and cheap... Texas doesn't even require applicants to complete a training course; you just have to file an application and take an oath. You have to pay an application fee, purchase a notary bond (which is basically a kind of malpractice insurance), and purchase your own official stamp and journal.

It's about as difficult and expensive as getting a passport, actually. Maybe a little more expensive, but not a whole lot.

Yep. I'm familiar with the process in another state. Usually the main requirement is keeping the license current, and letting the state keep track of you. Only pointed it out for completeness sake, and because the timing of the affidavits was interesting.

Notarizing requires the person to be physically in front of you. Vic's was on Aug 30th and notarized by Ty, implying he did it in their office on the last day possible so they could cover every scrap of info that's come up. Chuck Huber's was ALSO done on Aug 30 and notarized by Ty, implying they were both in the office at the same time talking to each other.

Talking to both men, at the same time, on the days after Toye+Funi's embarrassments, produced those affidavits. So they did not address certain things, not because they came out too late or didn't have a chance to compare notes, but because they intentionally chose not to.

Probably not meaningful. But it's worth noting in pursuit of greater autism.

A LETTER TO THE JUDGE instead of a motion? oh pleeeease.

If working Texas lawyers have blacklists of slimy characters and how to deal with them I sincerely hope Lemoine is on that list, and his shenanigans here get added to his record.

This act of discovery abuse must be particularly horrifying. I'm assuming so because Kevin Landau was never sanctioned, and the opposing council in Vic's case is flagrantly refusing to comply with discovery, showing that they do not fear sanctions at all. Ty must have given the judge a really mean look and wheel-kicked her potted plant.

Either that, or the office computer sputtered again and send false subpoenas to everyone in their email contacts.

According to Ty and Nick from the stream on Tuesday night, that is currently being appealed; there's a filing number for the texas supreme court IIRC. Lemoine lied in his filing.

The sanctions against Ty were because of a demand for evidence that he sent. I think it was supposed to be some type of "hey, we need this evidence and we'd like to get this done simply and quickly, so if you could voluntarily send it to us we'd appreciate it, or if not we'll have to go through the whole process to issue a subpoena and force you to comply," which seems in tune with his style of trying to get things done cooperatively as opposed to adversarially, if possible. The court thought that the implied threat caused it to cross the line into falsely appearing to carry the weight of a legal subpoena, when it wasn't actually a subpoena and thus wasn't legally binding in any way (and I imagine maybe the opposing side got assmad about it because it didn't give them the opportunity to ask the court to quash it).

To be as charitable as possible, he might not have known. It didn't go up to TSC as In re Beard but as part of a TSC appeal on a number of other issues, and was actually rather difficult to find.

I'm kidding, but I am a little disappointed that the man who loves to talk about knowing thine enemy and seeing things from the opponent's perspective apparently failed to prepare for a scenario in which he has to go up against a cranky old judge who does not appear to respect the letter of the TCPA.
