From what I've seen of the case dismissal the thing that stuck out to me was the public figure part where Chupp gave his reasoning for it. My question is, did TY ever take any time to argue why Vic was not a public figure?

I don't remember Rackets ever reading a section in the filings that said as much or even glossing over it and mentioning that it was there. Lemoine did counter with a reason why he was a public figure. Is it possible that this is the lynchpin for the dismissals?

That's what I was talking about. He actually takes it that he's a limited purpose public figure in the hearing, but in the verdict, he just says "public figure". There's massive discrepancies between what Chupp says and does in the hearing and what he renders in his written verdict, even with all the bench rulings standing.

Another example is him saying that he'd probably consider the unsworn declarations, letting Ty refer to the unsworn declarations without interruption by virtue of employing inadmissible evidence, and then in the verdict proper saying that he didn't consider the unsworn declarations.

Oh, for some reason I thought you were referring to the verdict.

I believe he makes an argument in the TCPA response, yes. I imagine they would definitely have to consider what was in the filing, especially since there was no proper discussion on the matter in the hearing.

The only arguments were in the first 30 pages. Nobody had to read 1200 pages to know that, although a competent judge would have at least known what was in them.

He did. If I recall it was basically that nobody knows who he is outside of anime and twitter followers don't mean shit in terms of popularity. He referenced a pug having many times the number of followers Vic has.

Instead of the hearing, the biggest thing that happened this week was caused by Ron NOT showing up to something. And it looks like everything in that first option happened without Ron doing it for once. Though, I don't think MBA's wife could get pregnant. He'd have to find his penis and get it in the right fold. Actually, even if he did get lucky, he has to actually be able to reach the vagina through both of their gunts. Maybe Ron could help, but he passed out from having to sprint back and forth with fresh snack trays.

I'm thinking Ty is a great marketer and PR man (hence the size of his firm) but he and his firm leave a lot to be desired in terms of quality. He's a wargamer, so it's fair to say his results in this case are Italian Army-tier, with lots of bluster and a few fancy initial salvos followed by some awful performance.

WW2 Japan at least had a few good commanders like Tomoyuki Yamashita, Italy had a bunch of faceless goons who accomplished very little but looking impressive and losing against weak opponents like Greece. Maybe like Italy, BHB(C) has a solid history of boastful yet poor performance like Marshal Cadorna in WW1 or the Italians who got BTFO by Ethiopia at Adwa. And like this case was pretty solid on the surface and it's merits seemingly wasted, the Italian higher officers wasted the skill of their junior officers and NCOs. They didn't even take over big chunks of their neighbors like Japan, they just lost and had to get bailed out (I really don't want to compare Martinez Hsu to the Nazis but KickVic already thinks we're all Nazis so whatever).

I guess the two nukes here would be taking advantage of the notary shit and getting Ty's notary license revoked and smacking him with some nice sanctions. I'm sure Fuhrer Westnile might come up with some good ideas for punishing Ty.
