Unless they're discussing the actual commission of a crime, talking about sick shit isn't illegal in the US. Having bad thoughts and talking about them isn't a crime. That said, there's no restriction on LE tasking some agents to comb through posts looking for evidence of CP distribution or other illegal activity.
