EU Weapon Ban for AfD Members: Ruling Now Confirmed - German courts rule that members of the only opposition party are to be disarmed... *Anarcho-tyranny intensifies*

Fresh publication over at Apollo News [A], translated by yours truly for the Kiwi audience

The Higher Administrative Court of North Rhine-Westphalia has ruled in summary proceedings that being a member of an anti-constitutional organization is sufficient to be barred from owning a firearm under firearms laws. This also applies to members of the AfD, even if the party is currently merely a suspected case.

This was announced by a spokeswoman for the court at the request of the German Press Agency (dpa). The reasoning behind the decision is the classification of the AfD as a suspected case of right-wing extremism by the Office for the Protection of the Constitution (Verfassungsschutz). This classification was confirmed by the Higher Administrative Court (OVG) of North Rhine-Westphalia in Münster on May 13 2004.

In two summary proceedings, the OVG emphasized that an AfD membership is already a sufficient basis for the revocation of a firearms license. It is considered especially aggravating if a party member is not just an ordinary member, but actively supporting the party as a functionary.

In its expedited rulings, the 20th Senate of the OVG claimed that it is also aggravating that one of the plaintiffs did not unequivocally and persistantly distance himself from anti-constitutional endeavors within the AfD. The court referred to inflammatory statements or intimidating behavior by party members.

The two summary proceedings were proceeded by rulings by the Düsseldorf Administrative Court at the end of June, in which it ruled that the respective AfD members must hand in their weapons (Apollo News reported on this). In doing so, the authorities had previously revoked the plaintiffs' gun permits, which they attempted to challenge in court. In the main case, four appeal proceedings are still pending at the Higher Administrative Court. According to the court spokeswoman, no hearing dates have been set yet.

When West Germany and East Germany unified, everyone believed that it was West Germany that annexed the German Democratic Republic of the East
They were wrong
They were right. East Germany was more based than West Germany and continues to be based. Don't blame your degenerate coomerism and cultural enrichment on a country you destroyed (and we betrayed, tee hee oopsie).

I think you misread or misunderstood what I wrote
I implied that, ackschually, the communist East German Republic is the one that annexed West Germany, and Germany is a socialist state

Yes, keep alienating this growing community that gets more fed up every single day. I'm sure there are no consequences.

On the other hand, it's Germans that we're talking about. They basically stopped going to church so that they had more time to worship government policies.

If I am the judge, I would probably agree with that position but it is not an extremly strong argument since gun ownership in Germany is a privilege and the law heavily focus on how personally suited a person is and how reliable they are.
It is relatively easy to get guns in Germany, provided you have the time for the necessary legwork for the paperwork the coppers want and the money to pay for things like a hunting license or yearly membership fees for a gun club (which is cheaper, even in the short term, because training and education required for the hunting license is a fucking expensive thing) and you don't powerlevel. And even if you do, it depends on your local community. Do you know some of the cops? Do you have connections to attorneys? All more or less important questions, in particular if you want to do edgy political stuff.

Nah, they were right, they just didn't understand that freedom to the american government and our west germany patsies just meant freedom for the people in power.

This ban is about official members, so nothing.
That's still 50000 members. They grew by like 60% in a year. Now old members and new ones that have hunting license or shooting ptactice have to get rid of their guns, or probably can't renew licenses as that'd be the practical way to do it.

Do germans have boating accidents and lose their gun that way?

That said, Weimar happened before American influence so whether or not we induced their sexual deviancy with denazification is a real chicken or the egg situation.
Considering one of the favorite pastimes for Wehrmacht soldiers on leave was dressing up as women... I think its safe to say the USA was not at all responsible.

What's the AfD's opinion on Free Speech?
Europe does not have free speech nor do its parties care for it. Right-wing parties pay lip service to getting rid of non-antisemitic hate speech laws but besides that insulting people, especially public servants or officials, tends to be illegal and there aren't any parties that want to change that (yes, left-wing parties are against insulting the police). The only parties in Europe that advocate for free speech are literal Liberalist-like parties whose campaigns consist out of throwing romans or talking about how much it depends on the child.

note that there's like a million exceptions to the insult laws and it's usually enforced by whatever the fuck the judge thinks of the official at that given moment

Well that's unfortunate.

God damn, were the Founding Fathers prescient with the First Amendment. As bad as the UK and Europe were in the late 1700's, they've somehow managed to get even worse.

If a person does not have a right to arm themselves, does this person have any rights at all?
I say no
