Any sane lawyer or PD wouldn't want to claim insanity anyway unless Chris was so out to lunch he couldn't assist in his own defense (which is a legal term that chris still probably passes. We're talking drooling nonverbal, or intense schizo 'only speaks in word salad levels of unable to function). The reason being that what he's accused of could at worst land him 15-20. Which is still a very lengthly stay.
But an insanity plea gets you sent to the looney bin until the state determines you no longer a threat to yourself or society. Which the end result being you pretty much only leave in a body bag.

You don't need seminal fluid alone to get a conviction or enough evidence for institutionalization. People get convicted for raping children a decade after it occurred.

Barb is old as fuck. Her vaginal walls aren't what they used to be when she was 20 and likely show evidence of tearing from Chris's crooked cock. Exactly my point earlier. Sometimes a crime is so heinous that the decision to press charges no longer rests with the victim (like when my former neighbor beat his [now ex] wife so badly she had to have her jaw wired and was unconscious for a couple days); likewise, when a victim is mentally impaired, the state will step in and file charges on their behalf.
I admit that I hadn't been keeping up with Chris for a while now, and if my husband hadn't so helpfully (ha) texted me the video of the conversation earlier today I likely wouldn't have found out for some time, but I have seen others here say recently that Barb is starting to show some signs of dementia, and certainly Chris says things in the recording that would indicate Barb was unaware of what was happening to her, or that she would suddenly seem to "wake up" in the middle of an act (I'm sorry, I still can't bring myself to type the words, give me another day to process). If she is, indeed, in cognitive decline, and the investigation indicates the tape was factual, the state of Virginia would definitely file charges on her behalf.
