Damn, I'm siding with John Swan on this one (never thought I'd say that again lmao). Kai Weiss went in there trying to avoid the argument, not address it.
I'll re-explain the situation: Akumu (some rando, not art commentary) raided Kai Weiss's stream chat. Kai Weiss, affronted by this obvious racist hate crime, made a video EXPOSING Akumu. Akumu responded, and Kai copyright struck his response like a bitch. Kai (and his friend Omnia) both argued that since at one point in Akumu's video there were four minutes of Kai's video with no editing, and that since 40% of the video was clips from Kai's video, and that since YouTube's ContentID system picked up Kai's video within Akumu's video, that the video wasn't fair use.
John pointed out in the first hour of his stream that, even though none of this has any say in whether or not the video was fair use (Kai's video was 14 minutes, Akumu's was 40), that Kai has actually made a video that is 40% someone else's video, and has included four straight minutes of someone else's video, and has previously criticized someone for including too little of his video in a response ("withholding context"), something that Akumu has stated he was trying to avoid.
Kai joins (without having watched any of the previous hour of John's stream, during which John outlined his actual points), and immediately, this happens:
"Why is Omnia in the thumbnail?"
"Because I disagreed with her take like I did yours."
"So she's included because she was agreeing with me?"
??? Yes? What is this faggy shit trying to insinuate that this is personal? She agreed with your dumbass take, and can thus be called a dumbass. Like you.
"Can you prove that what I did was illegal?"
"No, that's for a court to decide."
"Then why are you saying you think what I did is illegal?"
"Because I think what you did would be ruled illegal in court."
"But can you prove..."
I don't even know or care if Kai is gay, but he definitely came into this thinking he could fag his way out of this situation.
"Are you a lawyer?"
"No, but I've personally studied copyright law for five years."
"How can you criticize me if you're not a lawyer?"
Nigga, are you a lawyer? The section below says "no."

"What's the complete context of the quote from the other case?"
"I don't know, I haven't read that case."
"How can you criticize me if you haven't read every case quoted in this case?"
Anybody that understands anything about legal papers can understand how much of a purposefully obtuse hardass Kai is by saying this.
It should be noted that throughout this entire garbage fire, Kai was talking over John as he was trying to explain his issues with Kai, and John was the one to ultimately hang up, saying that Kai was the most intellectually dishonest person he'd ever had the displeasure of speaking to, and that he hoped people saw Kai's behavior on the stream and saw how much of a disingenuous person he is.
While I'll no doubt laugh at the memes people make of John going "Kai, would you shut the fuck up for one second?", I probably would perform similarly in a call with an art commentator. God, those people are such cunts.
