I'm no lawyer but I'd guess the Bank wouldn't really give a shit unless there was money being siphoned out of his accounts or something. He'll probably get an apology and some boilerplate statement about tightening security measures. Plus if these statements are true, it's not as if Phil has the cash necessary to pursue legal action vs the Bank of America, and doing anything like that might involve him having to go over his accounts in detail during the case, and there's no way he'd open himself up to that as paranoid as he is.
