The thing that he doesn't get is that it's his responsibilty to find a place to do his community hours and there were plenty of places that would take him. 50 community hours is a laughable amount, especially to someone who's unemployed. Dude could have easily worked off that sentence in two weeks and there was plenty of time.

I bet he never truly tried to find a place, just assumed the haters would make it impossible anyway (so why waste time trying?) and moved on. If he got letters stating "Sorry, we don't want you to do your community hours here", he could use that in his defense, but he clearly had nothing to show for himself.

He truly believes that his whining over haters impresses people and makes them accpet it as a get-out-of-jail-free-card (literally).
I had to chuckle when I got to the part of the video where he mentioned his Lülülü-Liste. Even his own lawyer told him its useless.

Edit: This is some CWC-esque "Snyder violated his own restraining order by not staying away from me"-logic.

People are saying 2 year and 7 months prison. Because he was originally convicted for 7 months but this was put up for a 2 year probation period. As he now is convicted again for crimes he perpetrated will still under probation, he should now have to do the original 7 months plus the new 2 years.
 
For all our non-German friends here I'd like to reiterate why it's not unfair that he got sentenced to 2 years in jail without probation. I know it seems much, and I also catch myself having a tiny bit of trollers remorse (even though it's all but gone after watching him play his stupid video games today as if nothing happened and smugly saying he'll just appeal the sentence). But ultimately, he had it coming.

First, he was already on probation for an assault charge from 2019. The conditions of his probation included 50 hours of social work and anger management training. He did neither, and he also continued to assault multiple people while on probation. You might say: Yeah, but he was just defending his property and people shouldn't expect him to stay calm when people come visit him just to troll him. This is true, and if it was JUST that then a second probabtion would actually be very, very likely. His haters acted like absolute morons in the trial so that didn't help either. So why didn't he get probation? There's multiple reasons:
  • As already stated, he ignored the terms of his probation. More than that, he didn't make any effort at all to try to change the situation, except sell the house, but that was all organized by the municipality so he hardly had to do anything but sign the papers. It still does count, but the judge rightfully rejected a potential deal with the defense by saying there isn't just "crime scene Altschauerberg" but als "crime scene Internet".
  • This brings me to the next point: He is fueling the hate against him with his videos and streams. The state's attorney figured that out without even watching a single of his videos. One of his favorite songs is Equilibrium - Unbesiegt (undefeated), and this song describes his mentality to a T. "I will stay undefeated, never knee and show humility" - no matter how dire the situation, he will never ever back down. He will continue to act like an arrogant asshole in his streams and he will continue to escalate any situation where haters visit him because he thinks if he backs off he's weak.
  • And he is also financially dependent on his haters. The videos where he talks about the haters are his most-watched. The streams where he shows the haters with his surveillance cameras (also illegal btw) are his most-watched. This is meant with "crime scene Internet". Nothing would change if he just leaves his incestuous Bavarian village, he will be found and he will escalate it again, whether consciously or subconsciously, and nothing will change.
  • The libel charges from the police aren't a big deal as such, but they work to stack the odds against him. He can't just expect to insult the police but at the same time depend on them for what is essentially 24/7 personal security service. The police are also able to do some math and show how much money it actually costs the taxpayers just to support the continous presence of Rainer in his godforsaken village. That actually makes a pretty good point to just lock him up.
  • He also dressed like a complete hobo for the trial, to the point where people are assuming he was actually gambling on pleading insanity, but if that's the case his lawyer must've told him that it would be a very, very stupid idea.
Everyone who was watching the trial said that it looked like he would get a second probation. Why were they wrong? I have a theory. I think they were very much willing to grant him a second probation (after scaring him a little) until the very last moment when Rainer said he would, under no circumstances, stop Youtube. He could have at least said he would voluntarily stop it for a year or so. Just SOMETHING to indicate he's serious about changing his situation. What he actually suggested was he'll continue as usual but he'll try to ignore the haters from now on, which is actually a pretty big meme in the Drachengame because he said that a million times and nothing ever changed.

So to sum up, his continued inaction to meaningfully change his life combined with his continued criminal actions were the reason the judge was forced to sentence him to jailtime without probation. The German justice system is very lenient, but they do not like to be mocked. Acting like a complete retard, wasting everyones time and ignoring generous offers is a surefire way to piss them off. It's not so much that his crimes were so bad, it's that he tried to fool the justice system for too long because he thought he would never ever actually have to face any consequences for his actions.

It's the assaulting people on public property part that's relevant here. And even if someone trespasses, it doesn't mean you can harm them with impunity. There's a difference between defending person and property and using excessive force. Even the most generous interpretations of Castle Doctrine have important conditions attached to them.

Good luck beating the shit out of some rando standing on the sidewalk next to your home and trying to defend yourself in court with, "yes, but other people have trespassed before!"

interestingly, there was still a law on the books until very recently in England that if you spotted a Welshman on the streets of Chester after midnight, you could legally shoot him with a longbow.
That's another case of laws overwriting others, it's just more convoluted because of the nature of Common Law systems and the fact that Britain doesn't have a constitution. So that leads to amusing situations like a Bong trying to dodge parking tickets by challenging the traffic cops to a trial by combat; or woketard articles literally shaking at the fact that marital rape and slavery weren't officially outlawed until the 90s, conveniently ignoring that marital rape was covered by laws against regular rape, and that English law never legally recognized slavery on its soil.

If you were to kill a Welshman with a bow and try to get off citing that old-ass law, the judge would just say, "nice try, but the Bill of Rights from 1688 supercedes this and clearly says that murder is illegal, as does every law after that. Enjoy prison, retard."

Funnily enough, the legal and legislative franework of the US is older than that of most European countries. Because most of it was penned in the 1780s-90s and has stayed largely intact, whereas the French Republic and Napoleon eradicated ancien regime laws throughout Europe shortly afterwards and wiped the slate clean. Even during the conservative restoration following this period, the kings of the continent were reluctant to abandon the French innovations that made sense, such as a rationalized, centralized legal system. There's some elements like the insult laws that hint at the older past, but in general most modern European law codes have their origin in the Code Napoleon.

But there are also enough instances where people just walked on the street in front of his house and Rainer started screaming and threatening them.
And if he would have punched the people on his property, he probably would've gotten away with it, but Rainer constantly chases after them down the street and gets into screaming arguments 20-30 metres away from his gates.

You also can't disregard that Rainer needs/wants the attention he gets from those visitors. In 2020 during the pandemic, there weren't as many visits at his place and the views on his channel tanked even harder.
Early this year he already had a meeting with the judge and got told to get his shit together, to stop giving the haters attention and to just let the police do their job.
What did Rainer do after this meeting? Whenever a hater would visit him during the livestream, he would change the stream feed to his CCTV so everyone in the stream could see what his haters were up to. Giving the visitors a plattform and even more incentive to drive to him.

Yes, in the States, Rainer would've probably already shot somebody (and gotten away with it), but this harrasment he gets is also on him.
I think you could compare him to the IP2/IRL streamers who walk around town saying stupid shit but then complain and cry when someone fucks them up for it.

With Rainer, I see similarities. He told people to leave, they attacked his door, fence and house. And it's not like he could run away from anyone.

And honestly, I wouldn't have minded. For all I care, he could have mowed all the people down who damaged his house or disposed their garbage on his property with a machine gun mounted on his balcony.

Just all started with that fag BasedGod and the first "big" visitors like the Norwegian and Rainbow sheep. Got a lot worse since KuchenTV and his kiddie community joined the dragon game. Since that it shifted from online trolling to IRL harassment.

Back at the start of the dragon game the focus was mainly just writing funny comments in his chat to trigger him or make funny videos. There have been entertaining people like Dorian and Drouuul. Rainbow sheep was entertaining too because his merely existence triggered Rainer into oblivion. Whenever Rainbow sheep joined his TeamSpeak server with a new identity he immediately freaked out and banned him. Also, rainbow sheep has a strong German accent that is common in Swabia, a province in the southwest of Germany) and Rainer banned anyone who had a similar one, thinking it was rainbow sheep. Rainer and Rainbow sheep also had some long discussions which were funny. (But rbs visiting Rainer and helping it become a trend was shitty af)

There's one time Dorian was able to join Rainers younow stream and talk to him. He asked Rainer why he thinks that skin isn't an organ even though it's a scientific fact. And Rainer said that it's not an organ in his eyes and he doesn't care what science says. Dorian then meant that he could say Amon Amarth is techno because that's how he sees it. Rainer started fake laughing and started insulting Dorian and said he shouldn't tell an Amon Amarth fan what he just said (Rainer didn't understand what Dorian's point was). Dorian answered "don't tell a skin fan that the skin isn't an organ". Rainer didn't understand that joke either. Stuff like that was entertaining to watch because you could see how dumb Rainer is without doing much.

He also runs after people which is so stupid. Even if someone is silently standing on the street, he'll go outside and shout at them, films them, sprays them with a gardening hose. He can't ignore it. I bet if he ignored the people from the get go it wouldn't have escalated that much and the police wouldn't be so annoyed if he only called when someone trespassed and he told them he is afraid of getting attacked. And if he then stayed inside and locked himself in until the police came they would be a lot nicer to him too. Idk why he chooses freaking out over protecting his own safety. I'd lock myself in, would have the CCTV recording everything and try to watch a movie or call a friend until the police arrived. Another fun fact about Rainer (as seen in this video): Like most Incels, he is totally obsessed with his heigth. He is convinced that being slightly above average heigth makes him an alpha male and he automatically assumes that he can win fights against anybody who isn't as tall as him.

He was on probation already and from what I heard he smashed someones face with a Mag Light, he was charged with Aggravated Assault or Grievous Bodily Harm, that's a felony assault, without all the other stuff he was charged with, try beating someone with a Mag Light in Texas under the same circumstances, you'd be just as fucked.

Winkler is (justifiably) pissed off at some vandalising asshat, but can't catch him, his rage boils and boils until Rainer manages to confront someone in person and then he vents his anger.

The irony is: those that vandalise his home run off like the faggot cowards that they are, while those that have been nothing more than a mild public nuisance stick around cause even though they do something idiotic and amoral, they aren't doing anything illegal. Those are the ones that Rainer actually manages to pick a fight with.

By default, he assaults "innocent" people. Sure, they're weeny asshats, but innocent in the legal sense all the same. The funny thing is: According to German law, it could very well be part of his property, but since it isn't fenced off (and mind you, a single chicken-wire at ankle height would count as a fence!) he can't press charges for trespassing. So even if those parts belonged to the ogre, you're still not in violation of any law when you're just standing there.
Additionally, say you threw down a lawnchair on the other side of the street, sat there, drank beer and just relaxed while looking at the house, also not illegal by any stretch of the imagination. Cops could show up and tell you to leave, but you're not committing anything illegal whatsoever by just sitting there and looking at the Ogre's den.
