This might be the out for the nervous jurors and for the judge, it'll be hard to put the blame on either of them when Binger is committing such cut and dry prosecutorial misconduct. This shit is so brazen, like how do you even think you'd get away with this grade-school level switcharoo? The arrogance is breathtaking.

https://www.law.cornell.edu/wex/brady_rule This is Brady,

The violation of Brady is grounds of disbarment and in some states criminal prosecution at the state level. Wisconsin is one of those states.
I remember that in the Chauvin trial people talked about grounds for things like mistrial were hit multiple times. And look how that turned out.

You mean more people might defend their lives from a murderous mob and kill pedophiles and abusers in the process?

Oh no!
A few more get dropped and Southern Wisconsin's crime rate might fall several percentage points.

Well prosecutors are rarely ever disciplined for their actions in court. Its to the point you would have to catch them in a blatant criminal conspiracy to actually see them get punished.

I guess Judge Schroeder is overly concerned with the idea of the sanctity of the court process and the jury in particular but if the verdict is anything but universally not guilty he needs to declare that mistrial with prejudice. Can he even do that at this point?

IF he can do it (I'm not sure the exact conditions necessary but it does exist in Wisconsin), I think the device would be called "judgment notwithstanding the verdict."

Yeah I’m jumping ship now
everyone to the life boats if you want
since i can see the writing on the wall

The whole system is on trial here
plus I’m doing a strategic retreat when this goes south
Isn't that good though? If the two guilty jurors don't cave we have a mistrial with prejudice and Binger probably in jail. Seems like wholesale victory to me. If what I assumed is true said superior of Binger would sacrifice him and piggy and Kyle is a free and very wealthy man.

If there’s a mistrial, that just means the trial can go again…and there could be stacked decks.

Yes, because those were procedural ground. Technicalities if you will. And may yet work for Chauvin but law is slow.

But there is no -may- here now. Brady is the one line you do not cross, the one line that even scumfuck prosecutors avoid crossing. Do you know how hard it is to get 'with prejudice' on an appeal? That's not just "Go and do it over" it's "you fucked up so hard, we won't even allow you to try".

That's what Brady is.

That I don’t know

"they gave us a lower resolution version of the video" seems like a very small thing. i doubt the court will just kill the entire case over such a minor thing. at most the prosecution gets a slap on the wrist.

You have to remember this isn't the first "minor" thing the prosecution had fucked up on. This would the 3rd in a list of shit the prosecution was caught doing.

They gave them the lower res version of a video the prosecution was using as the cornerstone of their prosecution. Rendering it near impossible to refute. That is the definition of withholding exculpatory evidence.

It would be a small thing if the pros didnt hinge their entire case on a blurry outline and """provocation""".

That Kate account is odd. Near round the clock posts. I assume paid activist. Posts hateful shit when theres nothing political to post, like hating someone who bought her a coffee and left a "god bless you' note.

Did an interview with some media bs about how she used bumble to catfish trumpers or something. The censored her image but she looks frumpy as fuck regardless. Apparently from MN.

Like I said, money on paid activist.

Some people just have no lives and tweet around the clock, like Moviebob.

Probably like Brooklyn Dad

they are the morons who would out live their usfullnes to the bad guy of a tv season.
In the interview she has a super scratchy voice. The head on her profile doesnt match the blurred shape in the interview so likely shopped.

My guess is some frumpy gross white bitch living in Minneapolis. Doesnt seem to have opinions, only repeats what the media says but with the typical leftist FUCK FUCK FUCK FUCK FUCK FUCK attached

Can this be used to rule a mistrial? Assuming Kyle isn't acquitted?

Right. After so much of a deal was made about different video formats etc in the case, and after the egregious violations of the 5th Amendment, etc, even if this was a considered a minor thing in most proceedings, it shouldn't be considered minor in this one.
