The ACW was actually pretty civilized. For the standards of the time and definitely of the 20th century. You had occasional massacres especially in the west, and of course Sherman’s March, but generally the armies sought to behave as gentlemen not savages. It was seen as unbecoming to rape and loot your way to victory.

A second American civil war would be far less restrained.

Maybe they are retarded and think the Not Guilty are actually the holdouts, might also explain why the State didn't jump on the mistrial either.

He may have been arguing in the alternative: "If you're not going to grant us a mistrial w/ prejudice, then at the very least this calls for a mistrial."

possibly because they thing it is more attainable than with prejudice, have faith that the state will not try again, or Kyle requested that they ask for just a mistrial.

what ever their reasoning they consulted with kyle and he agreed.

Thanks (I think). If they find him guilty then I think it is a miscarriage - unless there is some information I am missing and I'm not on jury so it would fair to say there are things I do not know. But from what I have found and seen I am just saying regardless of the man's character we can't put his beliefs or personality on trial, just the facts. The facts would lead me to find him not guilty.

If I were him, I would have shot Rosenbaum without question and without hesitation. As for the other fellow, again, the facts indicate to me he had as a good a reason as anyone to think he was going to be subject to serious harm. If a man is willing to physically assault you - and you are the one holding the gun - it is fair to say the person attacking you is willing to gamble he can take you and your gun down.

1: the motion with prejudice is still open, he's presented the judge with both options.
2: the State has so utterly fucked this trial beyond recognition that any attempt at a retrial would result in Kyle walking by virtue of the sheer magnitude of bullshit Binger and fatso pulled.
 
I’d be concerned with judges-the old boomer judges will eventually retire and you’ll have Laquisha Nigerrica who majored in Critical Race Whiteness Law deciding your fate.

With a jury you at least have some hope someone is sympathetic to you.
I had to go before a Black Judge in a city who wore a BLM pin and went on for hours for a fucking ticket because the cop didn't give me the right date. I did a web search on the guy, he married a white chick, he has an apartment in the city, but lives with his family in the suburbs. Dude is basically hoping to be Jessie Jackson or Judge Joe Brown.
