NEW DOC:
Motion filed by Appellant Russell G. Greer to extend time to file appellant/petitioner's brief until 01/06/2022
It will almost certainly be granted and Skordas would be wasting his time and Null's money to oppose it. An extension either to retain counsel or for recently retained counsel to come up to speed is fairly routinely granted. The only reason I can imagine it being turned down is if they somehow already decided to dismiss the whole thing out of hand.
Jewsh is kind of a retard in how much he trusts fair use when it's such a case by case thing.
There was never a fair use argument in the case. He never even properly pled contributory infringement, or so found the lower court. Usually, one can't introduce new arguments on appeal, but I assume they have some inkling of an argument they should be allowed to in this case.

The copyright claim for the song was never retarded tbh, he just drowned it in so much stupidity the shreds of validity were invisible.

What is his claim here, that Kiwifarms is hosting a copy of his song? Did he ever manage to file a DMCA correctly on it?

if i recall correctly the song wasnt even hosted here, it was hosted on a google drive that was linked here

You're thinking of his book.
He hosted his songs on YouTube (aka Google) which were then posted on here. He'd have to file a DMCA with Google (which he'd lose since he hosted them there himself). I really don't understand how his case didn't get dismissed right from the get go.

Abide by DMCAs for copyrighted content reproduced in full
So bow down to DMCA's then? You do realize most of the shit here is "content reproduced in full"? Congrats, Mastermind, we just lost the site. Give up our rights, such a genius solution.
So, uh, is Skordas gonna help out or is Josh all alone for this one?
Null has hired Skordas for appeals, yes. No Skordas will not object to the latest motion.
You're thinking of his book.
It was hosted here for some time before it was removed, IIRC. Russ did manage to catch a screenshot of the book once being posted here.

I don't think he even really provided a link to the song which was hosted here, because he's a fucking retard.

He claims that Null contributed to the infringement of the book and the song
Did he ever manage to file a DMCA correctly on it?
Null did not comply with the DMCA he recognized as valid.

Hmm. That looks like pretty safe fair use. At least if it's not, a huge amount of heretofore thought legitimate content is not protected. Like this whole site, and Rekieta Law, and half of the people I follow on Youtube.

But then as I said earlier, these attorneys have yet to meet a fair use they liked.

One would think they do, if they're competent counsel, but if they haven't even read his case then maybe they think this is a different scenario than it really is.

  • Agree
Reactions: Drowningman
The link doesn't appear to be correct, at least not anymore, but my best guess is that he's referring to the reposting by @Russtard of the lyrics to well-known masterpiece, "Girl, I Don't Get You" here.

Legal Guys. Are these 2 Russ got one step above or below " Ambulance Chaser" level?
I think they're trying to set up a track record of taking anti-fair use cases so they can sell their souls to Satan and work for some utterly evil intellectual property firm. This is sort of their demo reel for the legal equivalent of starring in a Facial Abuse video.
More and more I find out of them, the more I think AnOminous was putting it very kindly. They seem to be political org hell bent on killing fair use (and pissing off the IRS).
