I always thought semi auto Thompsons must have a longer barrel than the originals. Honestly, I would go as far and say that neckbeard is posing with some Japanese Airsoft Tommy Gun.

It is not barrel length, but the type of sear, that is in the reciever that dictates whether an item is a machine gun. But US gun laws are extremely autistic. Any NFA item must have a tax stamp and papers etc. So if the gun has an auto-sear, regardless of the barrel length, then it is an NFA item. The forward pistol grip looks too flat and long which leads me to believe it's a non-firing replica or airsoft.

Funnily enough the popularity of guns, like the Thompson, with gangsters in the 1920's and 30's were one of the main factors behind the creation of the NFA.

Slight PL: Yes, hummingbirds are attracted to the color red. It’s basically why the feeders tend to be a deep red color. But don’t add red food dye to your water.
