That would help bolster their decision to not let him on. If they can prove he view women with contempt (he does) they can argue he would have been a danger to the female judges, staff and other contestants. I mean, his whole act is hitting on Heidi Klum, a woman is who is married. To a black man. They seem to have done their research on Russ, so I think you're right, this is a calculated move to give him a chance to show his true colors. They wouldn't have to prove shit in arbitration, his own words could be used against him.


The lawsuit was filed by nine black men who had been disqualified from the show for various reasons, chiefly among them failing to disclose arrests. One guy was spiked because he was contractually tied to a band at the time, and there were some legal issues regarding that and Fox didn't want the hassle. This was nine years ago, and Fox pointed out at the time that three of the winners from previous seasons were black, and they've had other winners who were black since then. Russ doesn't stand a snowball's chance in a blast furnace against Ms. Lens.

Yes, and that'll make the trauma lumps throb even more if Dear Leader gets fees from him as well (I doubt that Russ would have to pay both Null's and Freemantle's fees, but one can dream.)

Maybe he'll be paying Freemantle and Josh $50 apiece every month for the rest of his worthless, wasted life. I just don't see the justice in saying, "You already owe fees in these other ludicrous cases you brought against people, so we'll give you a break on paying costs in your future braindead cases".

I'm thinking Freemantle may demand so much from Russ that he could bring it up as another plight to the judge in Null's case: "I can't pay Null's court fees, those meanies at Freemantle are taking every spare cent I have!" He has the luck of the retarded, so he may well squeak by on that point.

And if he can't/won't pay Null, hopefully Null can have Russ's possessions taken and sold to us as compensation.

Russ and Melinda have already opened my eyes to the failures of the American civil justice system. My faith in said system is hanging by a thread. If a judge actually says, "You poor little retard. You just keep suing people and having to pay expenses when you lose, don'cha? Well, don't worry, you don't have to pay court costs anymore, so run along and file your next IFP suit against the next random asshole who offends you!" I will officially be ready to burn the whole thing down.
 
I wish we had the beginning of that email chain. The subject line: 'Question for your clients to ponder,' makes it sound like Russ started off the whole thing. What was the stunning insight that Russ felt he had to present to Fremantle? That they were going up against an experienced and brilliant paralegal who had been told by numerous lawyers that he absolutely had a case? That Fremantle wasn't going to look good when the news started covering how they are discriminating against the disabled? That Russ is such a cool and talented guy that they are only hurting themselves by not having him on?

I want to know the details- but it looks like this is going to go quiet pretty soon. Clearly, Fremantle wants to deal with this in arbitration, and the court is absolutely going to agree to that. So we'll have Russ trying to add the other party to the suit, Fremantle's motion to compel arbitration, Russ' freakout over that, and then it'll go to the mediator and we won't get any more documents...

Given how quiet Russ has been on social media, I don't even know if he's going to sperg out there after it's over and give us embarrassing details trying to explain how he was done dirty. Does Fremantle have a Yelp page? Maybe we'll get a juicy review.

If anything, sanction awards go up as a vexatious litigant establishes a pattern of not being deterred by lesser awards.
 
The email chain from the end of the PDF is gold!! The contrast between the tone and professionalism of a real lawyer and Russ is *chef's kiss*. He can't even be unboomer enough to remove the iphone ad signature line lol and then links to his useless website. He doesn't even use the full word regarding or bother with a period at the end of his sentence fragment. Is the terse tone a sign of upsetti spaghetti gourdhead knowing he is being backed into the pay to play arbitration corner?

I 100% believe the tone of his response is a sign of his trauma lumps throbbing from being confronted with the fact he signed a binding contract and he's locked into arbitration. Not only will he not get his chance to just explain himself in front of a jury, but he's going to be forced to pony up cash on his end instead of getting the easy peasy free ride under the IFP statute. He's doing what he always does when he's called out on being wrong and not getting his way: shutting down and seething.

It all goes back to your original point: Russ needs to suffer financially, and it needs to be impressed on him that if he tries to fuck with Null and the Farms like this again, he will not only lose the case, but he'll lose money and possibly possessions.

I agree with this, and I believe it's supported by his past litigation history. For example, his first lawsuit attempt against something approaching a celebrity was when he tried to sue Farrah Abraham. What happened with that? Farrah filed a countersuit, and Russhole immediately pissed himself and dropped his claims rather than risk losing money himself. Russhole has attempted to sue his pop star obsession Taylor Swift three times now--always filing IFP--but he only tried suing his other pop star obsession Ariana Grande once. Why? Likely because that time he got his dick slapped down with a judgment against him for attorney's fees (which he tried to ignore but finally had to pay up after a sheriff showed up at his door with a summons). Russhole can't stand the thought of having fewer dollars to put in the hooker fund. He has no conscience and no morals, only ego and self-interest. Only him facing a concrete loss of wealth and possessions as a result of one of his lolsuits against a victim will dissuade him from filing suit again against that victim.

I don't think Russ is the only person who's tried to pull a stunt like this. I think Freemantle is the sort to crush people who bring lawsuits against them, as a warning to other would-be litigants.

Yeah, as others have said on this thread it would be pretty stupid of that company to set a precedent that you could sue your way onto the show. That would open the door to thousands of butthurt "talented" people who audition each year and also don't get accepted.

The thing is, there is supposed to be a check on the system to prevent crazy narcissistic retards like Smelly Melly and Russhole from abusing it. There's a statute (I don't remember the exact citation, the legal Kiwis would know) that says all lawsuits filed IFP are supposed to be reviewed by a judge to make sure they're not frivolous before they can go forward. Smelly Melly had 4-5 lawsuits rejected for this very reason before she finally found a judge dumb enough to let one go through.

Unfortunately the judges in Russhole's lawsuits have not done their due diligence under this statute when they should. I can see them letting the lawsuit against Null go through (for the copyright claims alone, the rest is a pile of bullshit), but Russhole's current suit against Fremantle is 100% bogus and should have been nipped in the bud. His claim boils down to "I auditioned for AGT and I stupidly told my friends/family that I'd made it onto the show when I didn't, now I'm embarrassed after having been proven a liar. Make Fremantle put me on the show so I don't look bad anymore!" There's absolutely no case there.

Definitely something like this. Russhole somehow thought crying and moaning about MUH PLIGHTS would evoke sympathy from a top-tier Hollywood law firm and their rich entertainment company client. Or he thought an absolute nobody like him throwing a toddler tantrum and threatening to "ruin their reputation" by whining online that they "hate the disabled" would evoke fear instead. My prediction is that when the lolsuit against Fremantle is forced into arbitration (as it should be), Russhole will drop the suit. This will be solely because he won't want to pay the fee for the arbitrator, because Russhole refuses to put his money where his mouth is when it comes to the law. He'll never shut up about this, pissing and moaning repeatedly online about the "unfair contract" that the "bias judge" enforced against him.

@Viridian the reply bug strikes again, but yeah, as soon as Russ finds out how much the fees are for arbitration, he'll throw a fit. He'll probably try some idiot scheme to force the case to go to trial, because he remains convinced if he can just explain to a jury, he'll be victorious. I dunno how he thinks that if he can't convinced one person he's right, how he's going to convince a majority of 12 people that he's right but this is Russ, hope springs eternal. Once it's sent to arbitration, he'll probably give up and move on to his next brilliant can't-fail plan. Honestly, he has a better chance of decriminalizing sex work in Nevada than he does ever being on AGT and our favorite hooker already deep-sixed that project.

From what I can find, Marathon is a music promotions company. I guess they do some of the advertising and promotional work for AGT? Why Russ wants to include them is a mystery, since from what I can tell, they aren't involved in choosing contestants.

what are the odds Russ tried to get them to promote his music to help him get on the show only to be denied. Now he's suing them for false advertising, discrimination, or some other nonsense. Because as a music promoter they have a duty to promote his music. Kinda like how Taylor Swift had to a duty to warn her fans she may not accept their gifts or gestures.
