The act of codifying into law whether or not abortion constitutes murder would still be the government deciding where that line is drawn, which would necessarily leave millions of people unhappy regardless of its decision. Thus the preference to have local governments make this distinction, with the federal-equivalent bodies staying largely apathetic (IE, the reality of what occurs in the event that Roe is struck down in the US).

There is some question on whether a Texas can punish its own citizens for seeking abortion treatments in states where the practice is not legal - though the practice only involves citizens of the state, it still concerns interstate commerce (IE, can texas pass a law to punish its own citizens for buying alcohol in another state with a lower drinking age if the individuals are not old enough in texas?), since abortion services are still paid services. And this doubtless again splits individuals, who might accept Texas' authority to ban the practice in its own borders but take issue with its suggested legal right to punish private citizens for engaging in conduct that is wholly legal elsewhere.

I find a lot of anti abortion folk have an idealized image of the 'babies'' they're defending. They think they are healthy, full of potential and let's be honest.. mostly white. The reality is they are often none of those things. Not only will a ton of blacks come out of this but a bunch of mentally retarded and FAS kids too.
