Legit question from a non-American, if the Democrats care so much about abortion, why didn't they draft a law explicitly legalizing abortion sometime when they controlled both congress and the presidency? I don't understand why this was left up to someone making a creative interpretation of the constitution in the first place.

Congress was side tracked with letting in as many illegals into the country as possible to solidify power, got distracted by dudes in dresses, and went on a riot session for a whole summer while parading a golden casket like Saint George of the Fentanyl

There is no Democratic enclave in the country with enough people sympathetic to abortion to shore up a move like that in such a way that it would not be immediately overturned and the poor sacrificial junior Congressperson would not be professionally (if not also literally) lynched. Abortion is a third rail now even more than social security as boomers begin to die, and do the status quo was maintained for sixty years by one decision made by a nonlegislative body. Liberals didn’t have to do anything except point silently to Roe v. Wade, allowing them to treat it as a fait accompli and therefore safely distance themselves from it, and conservatives could dredge it up whenever they wanted to make an argument for more limited government. Everybody won, except for all the baby corpses.

It wouldn't really have accomplished much, as the Republicans could have just overturned the law as soon as Trump became president, and the SCOTUS could still have declared any law passed by congress to be unconstitutional. The only surefire way to guarantee the availability of abortion throughout the country was via a constitutional amendment, which was never going to happen (though on the flip-side, neither was any possible amendment that would have completely banned abortion).

It would be filibustered. They would never get 60 senators behind this. Same with gay marriage and many other acts. This is the cause behind the legislation-through-litigation phenomenon on both sides.
