Armed Protesters take over Fed owned Building

Yep. Another chapter in the Cliven Bundy saga. Protesters have taken over a Federal building in Oregon, claiming the government is using unfair tactics to try and get them to sell them their farmland. Shit hit the fan when ranchers where arrested for arson. The ranchers claim they where doing it to kill off invasive crops and to prevent wildfires. The protesters think the arrest was the government trying to punish ranchers.

But this is complete bullshit. The state would have never had any jurisdiction whatsoever to prosecute over federal crimes over the destruction of federal property on federal land.

The case was brought by the federal government, under 18 U.S.C. § 844(f)(1) which states:

"Whoever maliciously damages or destroys, or attempts to damage or destroy, by means of fire or an explosive, any building, vehicle, or other personal or real property in whole or in part owned or possessed by, or leased to, the United States, or any department or agency thereof, or any institution or organization receiving Federal financial assistance, shall be imprisoned for not less than 5 years and not more than 20 years, fined under this title, or both."

U.S. District Court Judge Michael Hogan instead decided to deviate not from guidelines sentences, but the statutory minimum, which he just can't do. The U.S. appealed in a timely fashion to the Ninth Circuit, which it is entitled to do, over the clear error. The Ninth Circuit remanded to the U.S. District Court for re-sentencing in accordance with the law.

The case went back to Judge Ann Aiken, who resentenced to the minimum, as required by law.

The sheriff has authority to charge and prosecute for state crimes on BLM land through a memorandum of understanding with the BLM.

I specified federal crimes, though. He couldn't have prosecuted for those.

I agree that the activities in question could have also violated different state laws and be subject to prosecution by the state.

Fedsmoker actually has a fairly pro cop slant oddly enough with his hatred of cops. He has made several videos saying that people who get shot by the cops did so because they "Didn't follow the given order". Like Fed smoker sees cops as corrupt, but also acknowledges that perhaps being obstanant against someone with a gun pointed at you isn't the wisest move.

He's often been pretty cordial with the cops he deals with even if they realize he's crazy and is deliberately fucking with them. For instance, he was hassling deputies in a courthouse. He manages not to get tased or beaten though, even when he's deliberately annoying them.

Even when he's being pretty verbally aggressive, his body language is never that of someone who's about to just leap at them, which is what gets cops edgy to the point they attack.

Yeah I'm sure they set up many snares and are out foraging as we speak. I mean they are such survivalists that they packed so little in the way of food and supplies because they wanted to show the government how real Americans survive. By handouts and scraps.

I assume they brought as many MREs as they could fit in their trucks, and plan on supplementing their diet with non-migratory animals like rabbits. If they're already trespassing on Federal land, they're already in trouble and they might as well poach. They've sent out a request for supplies, which has led to some mockery, but I'm suspicious. I think they're hoping some sympathetic dupe will come to their aid and get shot by the Feds. That allows them to garner sympathy to their cause.

Right now, the vast majority of Americans are indifferent ("What the hell are they going to accomplish?") or outright hostile ("They ought to be killed to the last man, and would have been were they not white"). So long as they can say the Feds shot first, they'll gain traction.

Maybe not. I will be somewhat disappointed if they aren't, but if it's all resolved peaceably, some of them won't go to prison.

You know, all these crimes are federal. You don't go to federal jail. You go to federal prison. For certain crimes, you go to federal pound me in the ass prison.

What I do hope, though, is that every one of these jackasses ends up convicted of a federal felony that will, under the laws of the vast majority of states, ensure that they will never legally own a firearm again.

Don't use your guns to commit federal crimes. That has always under the Constitution and any relevant laws been sufficient to say "no more guns for you."
