I think you'd only really need a bill passed to fund it, I don't see any reason they couldn't handle everything else through executive branches. They'd get immediately sued by the red states involved, obviously, but it's hard to guess what arguments they'd use against it and how well they'd hold up.Wouldn't there need to be a federal law passed in order for that to work... and if it did pass(which might be unconstitutional due to the 10th) wouldn't that eliminate the problem anyway so they wouldn't need to be performed on federal property?

Yeah, I imagine it'd be difficult to get past HIPA protections to prosecute it if people kept their head down and didn't broadcast what they were doing there, but you'd still have to be dumb as fuck to put yourself in that position.
