Aug 9 2022 - Continuance on Grand Jury, defense filed motion for autism disorder deferred disposition

Nikolas Cruz has horrible autism, and he's still being punished. Zachary T. McClimans or "Claire Wolfever" shot up his manager at Walmart, and now the manager poops through a bag. Zack also has autism but he's in prison. Chris however could eat Barb's heart while bleeping a child, yet he would be given a parade and showered with hundreds of roses while morons here would say dumb shit like, "Chris isn't inherently evil. He's just autistic. It's society and his parent's fault "

That definition specifies that this is only true "under this new law"; this law doesn't go into effect until 2025.
From the Juvenile and Domestic Relations District Courts Informational Pamphlet:
"JDR courts differ from other courts in their duty to protect the confidentiality and privacy of children and their families who have legal matters before the court. The general public is excluded from all JDR court hearings, unless the judge authorizes a person to be present. Exceptions include cases where the child is 14 years of age or older at the time of the offense and is alleged to have committed an offense that would be a felony if committed by an adult, and cases involving adults charged with a crime. However, the judge may close any proceeding to the public for good cause shown.

Records of juvenile cases, both delinquency (where a child is charged with an offense) and civil (custody, visitation, support, and child dependency), are confidential and cannot be inspected by the general public. Exceptions include cases where a child 14 years of age or older at the time of the offense is found delinquent for an act that would be a felony if committed by an adult, and cases where an adult is charged with a crime; records of these cases are open to inspection by the general public. However, a judge may seal (make confidential) a case or record within a case. "
The judge can seal it at their discretion. it has nothing to do with the status of the case or whether it has been dismissed. The judge handling the J&DR case sealed it after it was closed and bound over to district court.

There is now a pending felony case in district court as well as the circumstances surrounding the case and victim making it a high priority to be sealed immediately. What it sounds like is normally it is a fast process to move from JDR to District Court in the event of a felony charge.

@Pointless Sperg If the motion for a deferred disposition was accepted, how long will it be until Chris gets out?

Probably very quickly. He'd go back to the jail, go through discharge and given his things, and then on to wherever he's going. I've never seen a case quite like Chris' before though, and I'm not very familiar with Virginia, and completely unfamiliar with the jail, so my honest answer is that I don't really know. Could be same-day, could be the next day. The main issue is that different states, jails, and courts have different policies.

On suspended sentence cases, they sometimes count the day of the judgement as the last day not suspended, and then you're released the next day, but sometimes they don't and you're released that same day. Some jails are notorious for kicking people out on the street at 12:01AM, but somehow I don't think they'll do that to Chris.

On the other hand with deferred disposition, Chris is still not sentenced to anything, so it could be like making bail where you get let out that same day.

So, sorry for the non-answer, but this is outside my experience. I don't see it taking more than a day though.

And remember, there are people here far, far more qualified than me, I just post more than them. Maybe @Learned Hand is around, I believe he's a criminal defense attorney. I avoid PLing specifics about myself as much as possible, but that's not my wheelhouse.

It really is a pretty reasonable approach for a lot of cases. I'd be curious to know if it has ever been used in a felony case, especially a felony sex offense involving incest.

I very much doubt it. Prosecutions of adult incest are rare, and middle-aged tards fucking their elderly mother are extremely rare. The statute is new, can't be used on a non-tard, and they're not going to give deferred disposition to someone for fucking their underage kids/grandkids, even if they are a tard. I imagine that in adult incest cases involving a tard, it's usually the non-tard that gets charged.

Again, this is outside my experience. I've never seen an adult incest case except on the news. I've never been involved in an incest case at all, just spoken to people involved in a few cases.

As for a different felony, it's almost certainly been used -- tards commit plenty of felonies, but I haven't searched for it.

Actually, it's easy enough to understand how dumb Chris is.

He simply just doesn't learn from his mistakes and his autism makes it such that the only matters he's ever concerned about are both those regarding his interests and the immediate outcome.

The factor that's changed over time is his motivations. Golden age Chris was simply an idiot. Current Chris is a delusional nutjob who thinks he's a deity heralding the Cartoon Apocalypse and has 'healing powers'. And this is more a combination of his own desires with his growing desperation to escape his shitty life in the laziest way possible, which is frankly literally waiting for reality itself to shit itself and crown him a goddess. It's really kind of sad that he'd rather pretend to be a bunch of make believe bullshit as he prefers that to his actual life in which he's done absolutely nothing of worth, and he'd rather continue not doing anything if it requires exertion on his own part with no instant gratification.

The problem with Chris is he's going to chafe super hard at assisted living the MOMENT he's forced to do something he doesn't want to do, while at the same time Chris pretty much passed an event horizon by screwing his own mother and then deciding she has to die for his own selfish benefit. Behind bars is likely where he's going to end up, may it be after this trial or the inevitable next one when he runs afoul of the law again.

Chris doesn't seem to experience consequences the same way normal people do. Losing thousands of dollars to trolls posing as e-girlfriends or exploiting his fantasies? He'll just go right back into doing that shit because it's validation of his beliefs.

Things actively threatening what he likes in a way only he interprets as threats? He goes balistic. Sonic's blue arms, the advent of Hasbro resetting MLP, even as far back as the Simonla incident, his greatest treasure is his fantasy built on stolen ideas and by the same token, it comes under threat in ways normal people never would give a single fuck about.

Same way with his spergout about wanting Barb dead or at least out of the house so he could live there. It's become literally enshrined in his fantasy as his 'Sonichu Temple' so the idea he can't go back there (or, y'know, make a 'new' temple) is beyond inconceivable to him. Even being forced to stop his stupid exorcism at Western State crossed a line, because it was a 'violation of his higher authority' in his mind, I'd bet.

The greatest irony is that Chris himself is the one who brings about these consequences to which he never, ever has a way to deal with.

Ultimately I don't think Chris really cares so long as he gets out. Maybe he'll damn the whole legal system to cartoon hell or that they'll be erased once the Merge comes, in a demonstration of his godly wrath, but he'll just shit himself and do nothing as usual.
I think the primary reason I still have interest in Chris even after all these years is the fact that he seems to be impervious to the consequences that normies would face if they did the same exact shit. As far as money is concerned I still have a hard time believing he lost thousands of dollars over a fucking moon laser aimed at his imaginary characters or whatever. More so that he basically shrugged it off.

Honestly I don't think they're even going to give him anything but probation and he's not going to give a shit anyway.

But who knows, maybe I'm wrong this time.

I can't quote A-No1's's post for some reason,

Probably because it's too long because I had to plow through two dozen odd pages responding. There's a way to get around that, but it takes a small amount of farm-fu.

I think Sperg means that an ankle monitor would possibly deter Chris from returning home.

Right up until Chris forgets it's there. Without something like a shock function to remind Chris he's being tracked, eventually he'll think he can get away with going back to Barb and 14BLC.

He'll make a few tests, going closer to his sonichu temple each time, untill he finally thinks he's getting away with it and will go too far, and then act all aggrieved when he's caught.

He didn't work to earn the money he lost. He'll get more money next month. The money means nothing to him. The only time he cares about money is when he doesn't have enough to buy whatever crap he wants right now.

Chris is adaptable though. He will rage about stuff, but he's terrible at thinking long-term, both in the past and in the future.

Remember, he used to *hate* 14BC. Moving back there was when he left the best time in his life behind. He desperately wanted to stay in Chesterfield County, and raged about the Greene County Conspiracy that prevented them from selling 14BC and being rid of it forever.

Now it's the Sonichu Temple.

He will make a new temple, I guarantee it. He just doesn't see himself doing it *right now*, because Chris never thinks about the future beyond things he wants right now.

Isn't that normal procedure when it involves a potential sex crime against a vulnerable victim?

Yes, though most proceedings should be open if it goes to trial (which it probably won't unless Chris fucks it up). Evidentiary hearings involving victims of sex crimes will be closed. You should be able to attend some parts (but not all) of pre-trial, and you should be able to attend jury selection.

The court can close certain sensitive portions, but it's required to be tailored only to the parts that are absolutely necessary. For instance if they show graphic evidence to the jury, the public will be excluded and only hear a summary of the evidence. They can choose to redact private information about a vulnerable witness (for instance if Barb takes the stand you might be kicked out, and sometimes proceedings must redact a victim's name, instead calling them "the victim" or somesuch).

If the judge tries to close everything, you can challenge it. This will be especially effective if you have media credentials.

There's no right for the public to bring recording devices to a trial though, unless the court agrees to it. In this case, they will not.

Yes. An autism deferral is also not available if the crime is of a sexual nature.

There's that thing too about consent, Ralph didn't have consent to post revenge porn but was somehow able to secure deferred adjudication so Virginia seems incredibly lenient when dealing with retards who get themselves in trouble committing sexual crime.

Edit: I was wrong about this.

I agree, Chris should be locked up for this.
I'm just worried the judge or jury will see that he's a retard who has the mind of a child and lives in magic pony land and will go easy on him like all the other times he's been in court.

This is my big fear as well. Chris has fallen deeper and deeper into his own fantasy world. He needs to be locked up or at least supervised for his own safety. Eventually he's gonna jump off his house to fly around Cwcvill and die. Or something equally retarded that's gonna get him killed.

Seeing a lot of seething niggos in this thread. Pour yourself a drink, sit outside in the summer warmth and relax - Chris isn’t worth getting getting MATI over. Point and laugh, never get personally or emotionally involved.

If - IF- he is let out it will just be the beautiful beginning of another chapter in Christory. I for one am pretty sick of this boring Stonechu Ocean arc and excited for what’s to come next.

What if Chris gets an incompetent bonehead lawyer next time?

It depends on where he fucks up next. If it's somewhere that can afford a pool of public defenders, he'll get one of them. It's likely they won't be incompetent. Despite the stereotype, public defenders rarely are. They simply won't have the time to give Chris's case any special consideration, and won't give any fucks either.

People need to look at the “exorcism” claim closer. Chris doesn’t say he actually did something. He said the hospital staff
“Don't even realize a simple Demon-Exorcism would have healed abcd, there, and helped zie to not pick at zie wound.”

He says an exorcism would have worked, not that he tried one. More like he’s grouchy because the staff wouldn’t listen to his holy advice. It’s even possible he’s making it up to sound Jesus-like.

This is relevant because people are using it as evidence that Chris has been fucking around with other people. Of course it is possible (anything is in Chrischanland), but we need proof it happened before we make a determination.

“But they put him in a chair!” Not necessarily because of whatever the “exorcism” incident was. We had thought he threw a tantrum when he found out he was going back to jail. That’s still the likely reason he was restrained.

Strong agree. As a human being capable of empathy and moral judgement, I would choose for Chris to be punished and prevented from harming others if I had the power to. However, I don’t have that power and I’m not going to pretend that I’m not very entertained by the colossal train wreck.
