The return of Phoenix Ralph. After his last legal campaign ended in Total Vickers Death, Ethan Ralph is back to publish more legal musings, which will surely be seen as having come from one of the greatest legal minds of the the 21st century.
You see, the Vickers clan haven't read up on Two Party Consent laws, and probably aren't even aware they existed. Idiots, outsmarted by the Ralphmale once again.
His plan is so fool proof, he is so confident of his ultimate success in court, especially after his previously successful legal manoeuvres secured him more continuances (judge a big KS fan I hear) that he's sharing his strategy for all to see -what could go wrong?
... What Ralph's Xanax addled mind seems to fail to understand is why it is that Two Party Consent laws make recordings of conversations inadmissible in most instances. This is because making the recording is itself a criminal offence, and from my understanding that makes this an issue of the fruit of the poisonous tree. It's equivalent to being wiretapped by the police and being prosecuted for what you've said, if the police had failed to get an applicable warrant ahead of time. The evidence would be found to be inadmissible and thrown out.
The relevant question here then, is whether or not recordings of DMs sent by Ralph are criminal. The answer to this is that they are not.
The reasoning is clear, when you send a DM via WhatsApp, Instagram, Twitter... or any service, you do so in full knowledge that this DM will be saved. Not only to your device, but also the device you sent it to and probably also to whatever server it was sent via. Therefore, you have no expectation that it would not be recorded. Ralph's argument is akin to complaining that a phonecall from a jail can be used in court, despite the fact those who use the phones are agreeing to the call being monitored prior to using them.
What's funnier is the idea that the Vickers' weren't aware of this - because I guarantee they are all very, very alight to these concepts. Remember, Ralph's saving grace in the revenge porn trial was that Faith was not allowed to bring in evidence where she recorded Ralph admitting he did it, because of Two Party Consent. The rules they had around it were so restrictive, that Faith decided not to take the stand regarding it. They know what it is, and consequently so do I because this is why what Ralph is saying wrung untrue.
However, it's also irrelevant - unlike Ralph the Vickers have hired legal counsel, people versed in family court and who can guide them through this. Meanwhile Ralph who has had every Pro Se motion he ever wrote flung out of court and laughed at publicly thinks he's going to be able to get one over on them. It's comical.
At least we know that these continuances haven't allowed Ralph to find a lawyer he can afford. Trial will be fun.

Ralph specifies that he is talking about "logs" in a further tweet. How can he know there are logs if he had an expectation they wouldn't be recorded?
Two Party Consent & One Party Consent are effectively wire tapping laws and only really apply when there is passage of information that you aren't expecting to be recorded - such as a phonecall.

I assume he's talking about the diary and how they're going to prove it was him who sent it. So, he's hoping that DMs he sent to Hatchet (does Vickers even have those?) cannot be included so that he can run with the "mah waif did it" story.
The "main" log came from Dedman posting it publicly, and both he and Hatchet verified the authenticity of the messages in a sworn affidavit, The logs specifically mention Ralph wanting to send him something very "spicy", so even if whatever specific DM he is thinking about is not admissible, the main log points to him orchestrating the whole thing.
I doubt this will help him, but it's fun to see that he left coming up with a defense for the last possible minute and is scrambling to find anything that can save him, and oncethinks he does, he pretends he's a legal expert.
Looking forward to the outcome, it's sure to be entertaining one way or the other.
