I suspect he learned something that contradicted his ideas about what was going to happen with the ethics complaint. They may well have asked even more questions which went in a direction Nick doesn't like. These days, Nick just doesn't do well when the world contradicts his expectations of whats going to happen in the legal system. I suspect as well that if the judge doesn't agree to his motion to dismiss, there is going to be an unprecedented explosion.

He was always on somewhat more shaky ground with that particular ethics complaint because depending on the dates, he could be found to have been acting as an attorney at the time in question. It was never any kind of slam dunk for him on that complaint even though he seemed to think it was. An ethics complaint with a direct tie to him acting in his professional capacity is far more dangerous than him just spurging on the internet.

As far as taking it to the supreme court, there are lots of expensive steps and several years of litigation to go through before there is any question of going to the supreme court. If he decides to go after the OLPR, he will likely be doubling down on his legal expenses.

I'll work on digging into what Nick said and when with respect to his representation status. Weeks ago I took some clips off of Elissa's channel created a super cut of what Nick said with the date superimposed, but it seemed like the ethics complaint fizzled out so I never bothered posting it. As you note, the dates of when he was self-represented and when he was represented by counsel are not really clear.

He also advanced as an alternate argument that, even if he was not represented, the ethics rules which restrict what actions he can take in the course of representing a client should not bind him as he was a lawyer who was self-representing and was not representing a client.

Nick is a lawyer in MN where he is sued, so he should be able to represent himself in MN.

Nick Rekieta is a person. He can represent himself in Minnesota (or anywhere in the country). An LLC is an entity. It isn't a person, so it can't represent itself.

What happened in the screenshot is that Rekieta submitted an amicus brief on behalf of Rekieta Media LLC in the appeal for the Mignogna case. Wolman pointed out that since Rekieta was not admitted in Texas, he really should not be submitting things on behalf of Rekieta Media LLC in Texas courts.

As you point out, Nick Rekieta is licensed to practice law in Minnesota. So there's absolutely nothing wrong with him representing Rekieta Law LLC in court. The problem is whether Rekieta representing one of his own LLCs counts as self-representation such that the OLPR would conclude that Rekieta should not be considered to be bound by ethics rules that only apply in the course of representing a client.

If Rekieta Law LLC lapsed after January it wouldn't matter for whether Rekieta was representing it or not since that was in January. I have no idea about whether LLCs that have been administratively terminated in Minnesota can continue to defend themselves in court or how that works. I know he can file the annual report and pay a small fee and the LLC will be reinstated retroactively because that's in the statutes.
