Russ, boo-boo, plenty of men with disabilities get laid consensually and for free. They use their personalities and humor and they have proper personal hygiene. I work with guys more “disabled” than you, and they have wives. Maybe their wives aren’t what you’d call 9s or 10s, but they are happily married. You’re just an asshole, and everyone knows it.
 
In terms of expended effort, posting an emoji in the timeline of a girl who you find physically attractive is even more low wattage (and about as effective) as changing your avatar to the flag of your preferred victor in any one of the many exciting wars that are collectively dragging us towards a state of global conflict.

It is hard to determine quite how Greer expects to develop meaningful connections from these dalliances along the attentional fringes of a various attractive young girls. I can only assume he imagines that, if he repeats the same tactic on a large enough scale, then one of his attempts will bear fruit. I am betting that he runs out of rolls of the dice before this happens, and that he would have a greater (albeit slender) chance of conditioning his body to a point where he can slobber to his heart's content on his own rancid penis.

If he was capable of empathy, which I don't think he is to an extent where it would be useful, he might view his unanswered exchanges from the perspective of someone who was born with pompoms where their hands should be: How is a hot, young girl supposed to respond to an emoji, perhaps accompanied by a few carelessly tossed-off words? Where do you do from there? If hitting on women was as easy as bombarding them with mutant hieroglyphs, then every available heterosexual man on the Kiwi Farms would be up to the hilt of their balldos in cheerleader pussy, and these forums would echo with the lonely sound of Josh's digital footsteps.

As the 9th circuit often shows, an en banc hearing does not necessarily prevent retardation, it sometimes just spreads it out
The Ninth is also so absurdly large that en banc doesn't even mean en banc. You only get 11, less than half of the 29 judges on the court.

To the extent this had anything to do with politics, we drew about the worst panel possible which more or less based its decision on making stuff up about the law and "Kiwi Farms Bad."

I'm still not very hopeful. Appeals courts are often reluctant to rehear cases.

"Compliant petitions for en banc consideration or reconsideration are distributed to each active judge on the court, plus any senior circuit judge, district judge, or visiting judge who sat on the original panel. Only active circuit judges have a vote on the en banc request, although a senior Tenth Circuit judge who was on the original panel decision may elect to sit on the case if an en banc rehearing is granted. En banc hearing or rehearing will occur only if a majority of all of the active circuit judges, except any recused in the case, vote to that effect."

Interestingly (in a section titled 'If Rehearing En Banc Granted'), "If the court should be equally divided on en banc rehearing, the judgment of the district court (not the judgment of the initial panel) will be affirmed."


So, in a sense, Null needs 51% of the 10th circuit judges to grant the motion for en banc, and then, at minumum, he needs 50-50 split to win (remember, the district ruling was good for Null)

This means that if they agree, all 19 judges will review Null’s case instead of the three Dem-appointees.

Edit: That means that if Senior Judges don't count (none were present to hear Russ original appeal), that would make not 19, but 11.

The majority of judges have to agree on it: https://www.law.cornell.edu/rules/frap/rule_35

There are two approaches but I can't figure out which the Tenth Circuit is. In an absolute majority circuit, you need an absolute majority of all judges on the court, regardless of whether they're disqualified, but in a case majority circuit, you need a majority of all the qualified judges.

This document by Gorsuch seems to indicate the Tenth takes the more lenient case majority approach:
En banc hearing or rehearing will occur only if a majority of all of the active circuit judges, except any recused in the case, vote to that effect.

Also if the court has more than 15 judges it doesn't have to be the full court but "such number of members of its en banc courts as may be prescribed by rule of the court of appeals." https://uslaw.link/citation/us-law/public/95/486

There's two tests they give you and they take the better of the two as your score.

One is a word association test. So like A is to B as C is to and they give you four choices you need to pick from that fits the pattern. The second is more or less, "what is the next one in this sequence". Or they show you three sides of a finished cube and ask you which of the four opened cubes would match the original one when completed. At least those were the I got when I applied. It cost you $40 at that time but that was 20 years ago so prices might have gone up.

Having said that, there's no way Russtard would have gotten 98% on either one. I refuse to believe he's smarter than he appears to be.
