Who could have ever seen this coming.

Here's what I'm gleaming from this video:

• Here's how Billy Mitchell actually lost his lolsuit...
• The lawyers settled because trials are expensive and they knew Billy Mitchell had a snowball's chance in hell of winning
• Jobst maintains that Billy Mitchell cheated and points to documentaries showing that he used MAME as proof
• Jobst also states that the only reason why Twin Galaxies agreed to put Mitchell's scores back on their site is because Mitchell hired a college professor to explain why his tapes appear to show him using MAME
  • Among other things, he says that the tape could indeed show him playing on unmodified hardware and that it only looks different because of tape degradation and that Mitchell probably didn't clean his VCR
  • Jobst promises a later video shitting on this professor.
• Jobst later shows that Twin Galaxies agreed to repost Mitchell's scores on their site... only it was reposted in a "historical database" and not on their official score list.
• Jobst shows an email from Twin Galaxies (which is purportedly sent to him) saying that Mitchell is still banned from the TG leaderboards and they still won't officially recognize his Donkey Kong scores.
• Jobst points out TG's merch store has coffee mugs and t-shirts that point out the difference between official DK software and DK software emulated on MAME.
  • The header for this page reads "Stand tall with apparel that honors all dedicated video game players and their honest achievements, no matter the game. Recognition matters. Truth matters. Community matters. This is the way." It doesn't mention Billy Mitchell nor does it show any likeness of him.
• Jobst ends his video by making statements about Mitchell's suit against him. They can be boiled down to "I'm not locked in this lolsuit with Billy Mitchell. Billy's locked in this lolsuit with me."
• Nowhere does Jobst mention the fact that TG's lolyer was a complete jackass who forced the settlement by doing jackass shit.

How is that nutty? It's pretty standard when you're being sued. Billy is the one who didn't shut up and kept lying publicly. That's why he agreed to settle, he knew his position was weak.

Why is everyone saying Billy won against TG? Is it just a meme? The details settlement wasn't made public, and TG maliciously complied by putting Billy's scores on their website in their own separate historical category, segregated from the rest. I can't imagine TG actually paid him a significant amount of money.

Settling a lawsuit is neither a win or a loss. Jobst knows that and immediately publicly claims a falsehood about Mitchell that would damage his reputation. That is the definition of defamation in the US but not sure how it works in Australia.

IMO (not a lawyer) the statements released by both parties including the wording about the new expert witness to me means both sides have agreed to say the evidence is inconclusive either way. That cripples Jobst's defense since he was clearly counting on reusing much of the work from TG's case.

In the US to claim defamation you basically just need to show that the other party made a statement and then they have to prove that they had a reasonable basis to make that claim. IMO Jobst was hoping to be able to point to Mitchell's loss here for much of his defense (that's why he's tight with TG's lawyer) or maybe have Mitchell drop the case altogether after being humiliated by TG. Now he must prove the fact that Mitchell is a cheater 100% on his own and that just became A LOT more expensive.

He was certainly counting on being able to do that.

Jobst has suggested before that Australia is basically loser pays the costs but I don't know anything about Australia. That could change the calculus for how far Mitchell is willing to go but it could cut both ways too if Jobst somehow lost and had to pay Mitchell's expenses. I could still see a similar settlement here. Mitchell has his own expert now with pretty impressive credentials and that adds even more risk to Jobst's case.

Anyone who voluntarily subjects themselves to the sort of lawsuit and demands to go trial has to be a complete retard. The whole ordeal functions as an excuse to burn money for what amounts to a ton of bullshit. The costs in retaining experts alone must be ruinous. Imagine bankrupting your family, your wife and kids, because you said some guy cheated at Donkey Kong and decided you had to "prove" that he cheated to satisfy the court of public opinion.

Even if you "win," and you're lucky enough to get fees awarded, congrats you broke even except you didn't because you're not going to be able collect those fees in all likelihood. You're never getting that money back.

Billy knew exactly what he was doing. All he need was for TG to say something to the tune of "Billy Mitchell's scores have been reinstated". Make the asterisk as big as you want. That's good enough to rally the paypigs. If anyone brings it up, all he has to say is "My biggest accuser, when faced with a trial, chose to settle". No one in the actual arcade high scoring scene will take him seriously, but they weren't even his target audience to start with. His only interactions with them has been to troll the shit out of them after him and rest of the old guard were pretty much ousted by the younger generations years ago when it was realized that the entire community was being run by pathological liars.. and a few of them were going to prison for pedophilia.

As far as Karl Jobst goes, his best hope is Billy just decides that the TG "win" is enough and doesn't want to waste any more money on it.
