If he had 26.67 grams with packaging, I wonder if the first argument is that he had less than 25 grams of actual illegal substance. Obviously the police were doing a field measurement, but since it listed multiple baggies, it's possible a full, controlled measurement would drop him to a lower charge. They just have to clear 1.68 grams, or 0.06 ounces, to dip below the threshold.

Like they planned to donate $100,000 to the charity anyways, so they'd let Nick go and act like a high roller and "spend" $100k on shitty art at a charity auction. It's not actually a bad argument. Considering that the prosecution/cops even mentioned it when it doesn't help their case suggests there are cases where not doing that bit them in the ass. It's really common to wobble something down based on technicalities like that.

That said I'm more confused than I was before hearing several lawyers arguing about it and forget whether 25 grams is actually a relevant threshold for anything in this case. I thought it was for the weapons thing.

The cops specifically said "spent" shell casings. They also mentioned coke bullets, which are those weird things.
 
Running a bit behind, but if cops found one big bag (18g+) of coke, and a bunch of small baggies, and a scale, and scoops and weighing pans, Nick is very lucky they didnt try to nail him with possession with intent to distribute. If there had been any significant quantity of cash in those safes, he probably wouldnt be so fortunate.

He seemed really good-humoured and wholesome and said that having a thread on here was no big deal - his was only a couple of pages and you have to expect criticism and take the rough with the smooth.

It all seems to have gone rather downhill. He went from popular legal v-logger to degenerate at warp speed.
