Don't know much about this, so I won't comment.-4th amendment violation:
---Drug testing violates the 4th amendment.
The problem is they didn't just find "something". They found multiple illegal drugs and Balldo had guns along with them while his kids were around. It's perfectly valid to remove the guns and kids when this dude and his wife are cokeheads.---Shouldn't be able to get a search warrant, remove the kids, remove guns, just because they found "something" in the search.
It isn't the same thing as swatting. Swatting is when the police go to a person's house with a SWAT team WITHOUT a valid search warrant. This is different, the police had a search warrant and investigated the pastor's report a week before executing the warrant. Also, we don't have the full context of the reporting process (i.e. one of the kids talking to the pastor, a member of the church saying it to the pastor etc) this argument can't be made without knowing the full context of what happened.---A search based on an anonymous report, hearsay (the priest's report) should not be performed. It's the same thing as swatting.
Lollibertarian argument not worth addressing.---Search warrants should only be performed against drug dealers.
Of course they wouldn't allow him to see his clients, they are codefendants which has a MASSIVE conflict of interest.-6th amendment violation:
---The jail not allowing Nick to see his clients while he was under arrest is a violation of the right to an attorney.
That's a fair point by what does it have to do with the 6th amendment? The 6th amendment is about rights given to defendants during trials (right to a speedy trial, right to legal representation, right to be aware of the criminal charges, right to confront witnesses during the trial, right to have witnesses appear in the trial).---That Nick wasn't told immediately that April was released is a very bad look for the court.
