And shit like this is why Rittenhaus fired your ass Barnes. This is a clear chain of reporting backed up by evidence. They followed a protocol to report child neglect and possible escalating drug use within the home where the children dwell. The initial reports stem from 4 individuals in the church with contact with the children. Their descriptions are of pretty clear neglect. Hungry, unwashed, wearing the same clothes all week, etc. These are actual red flags to any and all mandatory reporters. They brought their concerns to the Pastor. Who reviewed them, looked at the Parents concurrent actions and behaviors, and decided to report it as he is required to do. Once again HUNGRY, SMELLY CHILDREN WEARING THE SAME FILTHY CLOTHES FOR DAYS AT A TIME. This is 5 witnesses with close proximity to the kids. This is what a Child Neglect Report looks like.

The report was handed to a very senior officer and investigator. He appears to have done as much research as he could using publicly available evidence that was published to the internet by the adults in the room. He saw to his eye what was clear drug use going on, on or just off camera. And before anyone goes 'Well he couldn't Know what Nick was doing in the Bathroom!!!" Yes he could. With 100% certainty. Because that is his area of expertise. And it was fucking obvious to us. The cops did some research, watched some Nich streams. Watched some Aaron streams that pretty clearly confirmed he was a witness or participant to drug use in the house.

They took this to the Judge and got a warrant

What they found in and at the house matched what was on the warrant. You can shout "we're going to have the warrant tossed!!! Unconstitutional!!! all you want. But they filed for the warrant expecting to find dealer levels of cocaine. They found dealer levels of cocaine.

Also First Amendment Church and State claims don't apply here. The reports were from the Church acting in its function as a school or preschool. No issue of Clergy Privilege. In this case the Pastor was acting as the Principal or Manager of the School program.

Barnes really needs to shit up. Because he is giving bad law advice over the internet, that Nick is likely listening to. This will impede any real proper advise that Nick may get from his local lawyer. Nick is fucked. But the path to unfuck things does not run through Robert Barnes bloviating malpractice.

What Barnes is doing is attempting to reframe the narrative in Rekieta's favor, otherwise known as spin. His problem is facts don't bear him out. Barnes can't, for example, know the minds and motivations of the parishioners he's claiming held a grudge against Rekieta.

It's about the kids. The pastor and parishioners at the Rekietas' church were worried about the kids. They knew something was seriously wrong. I grew up in a dysfunctional and violent alcoholic household until I was nine, and I'm here to tell you it fucks you up. Our teachers knew something was amiss with my brother and me. We were getting in fights and acting out. We were unwashed, hollow-eyed from lack of sleep, and obviously malnourished. And yes, I know the Rekietas aren't poor, but I would bet the farm one or more or all of them were presenting indicators of enormous stress.

Sadly you'd be surprised how long people will let this go on for or excuse it. My family still try to play down my own junkie parents neglect with "Atleast you weren't fiddled" level ripostes. I, to my shame, never had the nerve to call the cops on them neither. That Pastor is a fucking SAINT, he probably saved those kids.
 
Maybe not the people from the church but I think the cops know what track marks look like and they noted it when he was arrested.
That doesn't say track marks, it says "sores that are common with controlled substance users." Meth and other amphetamines can make you scratch and pick at your arms. Opioids can also make you scratch at your arms. If it were track marks, the police would probably just say track marks rather than be roundabout and frame it as "sores."

Could the more legally experienced people in this thread clue us in to how common it is for a valid search warrant for a domicile to be granted based on an individual behaving erratically and obviously chemically altered?

Because in my lay opinion, the appeal stream alone would be enough evidence that Nick was using controlled substances.

Barnes is out here acting like the warrant was insufficient and based on hearsay, but in my mind the way Nick himself acted makes the whole thing pretty airtight.
 
I'm willing to bet cash money that one or more of the church parents took the kids to their house and fed and cleaned them up. They would do this one or twice before they'd start to mention it to the parents/other parishioners, and then to the pastor. Parents are very forgiving and understanding of the realities of raising kids, they always say they're hungry and often are messy/dirty, so if they noticed then it was something serious. And any parent knows the difference between "I want snacks" and "I've not eaten for two days".

As pointed out above, the preschool teacher is also likely a mandatory reporter and that report sounds like it was separate from any others. Again, I think there's an unreferenced CPS report somewhere.
The CPS investigation would be going on concurrently. But would be based off of this report to the police. The Mandatory Reporter does not need to go to both agencies. Going to either will trigger both. CPS is probably nowhere near complete. But they don't need to be the Cops facilitated removing the kids from the home, and they are comfortably housed with Grandparents for now. So CPS will take a little longer to generate their reports. And we will never ever see them.
