I actually don't think she is. The prosecutor doesn't really need her for anything related to Nick unless she's aware of some enterprise he was running. She might be useful in identifying the dealer who they bought 26 grams of coke from in Minneapolis.

Nick didn't really lie when he said she was visiting. She is, and she could've continued visiting for a month or so until she found an apartment. She certainly isn't a resident of the household. There likely just wasn't enough to bring a proper case at the time.
