Well, that would be the smart, disciplined, rational thing to do. It would certainly be something a competent, practicing lawyer would do. Which means he was probably just winging it.

He may have the option of claiming the CPS report was leaked and that compromises the case against him (ergo it ends in a mistrial), although apparently the cause wasn't so much a leak but an improperly stored document on a publically accessible terminal. That won't stop Nick from trying that angle of course.

From the document thread, it should be publicly accessible from a "public access terminal" just not online through MCRO as the site says:

The referenced sub section talks about how CHIPS records are under "District Court Case Types With No Remote Access".

The same "Record Access" document says under subsection 1 "Upon request to a custodian, a person shall be allowed to inspect or to obtain copies of original versions of records that are accessible to the public in the place where such records are normally kept, during regular working hours. "

The court is saying they'll give out copies to the public, just not through MCRO.
