Since the arrests broke I've been thinking that the only possible defense either one of them has is to blame the other. Otherwise they're both going down.

This is why he'd never be allowed to represent Kayla even if he tried the criminally corrupt route of doing that.

There is also an ethical conflict of interest between them if they had the same lawyer. The fact that they would not be able to blame each other as a defence is an ethical issue that would almost certainly be disallowed by the court.

It's called a nonwaivable conflict of interest. Many conflicts of interest are only potential but require informing the client of them and getting consent, but could become conflicts in the future, so having a plan for backup counsel is important if the conflict ever ripens.

This one is so obvious the judge even remarked on it at the arraignment.

I still wonder if Kayla did a complete u-turn, going to rehab, stabbing Nick in the back with divorce, and genuinely trying to get better if she'd get off and get the kids back. However, she doesn't seem to be doing that. I can't imagine her lawyer wouldn't advise it.

If it truly came down to a jury of their peers deciding on their guilt, I extremely doubt that them blaming each other would get them both off the hook. At that point, they're both admitting to facts of the case which incriminate both of them, but impotently trying to shift the "blame" for who masterminded it all. They'd both still be incriminated unless the jury are retarded or evil (which can happen, some juries will rule "not guilty" even if the accused clearly did it because they feel sorry for them, but I don't see it in this circumstance).

1. The level of access Nick has with the family trust vs his parents control.

I have money on at least an attenpted move out of Minnesota for all Rekietas concerned at the conclusion of the criminal case if they are not locked up.

Nick might have been able to flip the script before he started going on YouTube and literally livestreaming, quadrupling down saying he was set up by the government liars, shitting on everyone, and then claiming somehow that he was gonna go back to "normal streaming of cases" without "alcohol or other substances". This dude is so delusional he thinks he 1. has an audience 2. has an audience besides the trolls 3. even does anything on streams without alcohol or substances to begin with.
