Nick has always been a mediocre "lawyer" with shit tier legal takes, he was lucky to hit success at the right time and his skill was getting good guests and being a decent host who knew what questions and things the layman watching would want to be asking. If you want to really understand the motivations and the ideas behind the film, replace Mena Suvari's character with a young boy. Probably the "Ricky" character because the Ricky character is a self-insert for young Alan Ball (the writer) and his relationship with his own closeted gay father.

Many places will have a few lawyers who the police call when you say "give me a lawyer." Sometimes they hang around at courthouses or police stations. They aren't free. You get them from the police or the court and then you pay them afterwards when you drop them for your own attorney. It just allows them to hold hearings without delay.

The Emergency Protective Care hearing on the children is as its name implies something that happens without any notice or generally time to prepare. Since its a family court hearing, they have to provide the parents with some reasonable opportunity to have legal representation. There is generally in the US system a constitutional right to attorney in a court proceeding. That right gets balanced in this situation against the fact that its an emergency hearing.

So generally in the case of people like Nick & Kayla the county will have set of attorneys that can come in and represent them in family court for the emergency hearing. After the emergency hearing, they have the option to choose any legal representation they wish including the people who represented them at the emergency hearing.

In Nick's case, none of these attorneys would be free. He would have to pay them.
