Your question confuses a broad societal acceptance of “live and let live” that you advocated for with the difficulty in actually enforcing laws that explicitly go against that world view. Sure, you’d probably have difficulty in securing convictions against people who just have gay sex discretely and privately. But there are already plenty of laws that is also true for.

The aim of those laws is not just to criminalize the act, but to shape society by setting the agreed upon norms. In this case being “no fags allowed.”

No would support such a bill and it would be a waste of legislature as well as waste of law enforcement time. Weed is still federally illegal yet people are needlessly prosecuted and imprisoned for it.

What is the point of an enforcing such a "norm" if all it does is waste time and resources for everyone involved. While homosexuality is definitely against the norm, the idea to entertain such a law is too little too late.

Besides the law is literally unenforceable, and no one with a right mind for a future in politics would support it as such.
