The warrant doesnt say they watched the backup does it? I thought it says they watched it on Nick's YouTube? So did the cops lie or did Nick just make it up because he thinks he privated it before anyone watched it?
Does the entire stream being preserved by Nick on his Odyssey come into play? Surely the cops must know about that by now?

Like, okay you admitted that you hid evidence and are claiming a different watermark counts as “editing” the video. Even if the judge sides with this stupid point, the police can just get a warrant and demand that Nick give them the original footage since he admits to still having it. They don’t need to subpoena YouTube. At all. OR, the judge will force Nick to supply the original video as part of his evidence against the police, which in turn will show that there was no material editing.
The upload source Nick is claiming the cops used didn’t label the video “Nick Rekieta Coke stream.” Or “Nick Rekieta on Cocaine” it was “Nick Rekieta drunk stream after losing his appeal.” It doesn’t imply any criminal activity.

The whole thing also ignores the rest of the warrant application.
The cop is very clear in the application that he watched multiple streams, noticed all the signs of someone on drugs, and then did further viewings to determine for a fact that Nick broadcasts from his home, which is was able to be verified in the coke stream. He covered his bases with a valid and reasonable explanation for why someone with his level of experience would suspect cocaine use as he’s been trained to notice signs of it, and explained how he conducted the investigation. He mentions Aaron and the Coke stream mainly as elements to paint the narrative of Nick’s decline, not to say that these were the smoking gun that made him conduct the arrests and the house search. I genuinely believe that, based on the warrant application alone, the entire Coke stream could be removed and it wouldn’t invalidate the warrant.

Same issue with him constantly bringing up the kids. The cop was made aware of Nick because of the pastor’s report of suspected child neglect, but he started investigating him for drugs after the fact. The kids are ultimately irrelevant to the warrant itself and the cops said as much, which is why they won’t use them to testify.

The “you had no warrant for the guns so you can’t take them” is also beyond braindead. They were seized because possessing firearms around drugs is illegal in MN. And they were literally in the same room as each other, so of course they’re gonna add that charge and seize the firearms:


The fact the best Nick could do is cry about Aaron, who is irrelevant to the warrant but might be a witness against him, cry that April spoke after being Miranda’ed(correct me if I’m wrong, but if you choose to talk after saying you won’t, that doesn’t mean the cops can’t use it as she waived her right to remain silent), cry about a watermark on an otherwise unedited video, and cry about “they had no right to take my guns” is just pathetic. This is all he could do?

Like I get it, he’s not a real lawyer and has no courtroom experience outside of motions to dismiss and taking plea deals, but I still expected something better. Barnes may be a bumbling idiot, but there’s no way Barnes would have told him to go this route
