Oh, they're not blameless in this at all, but the judge is the one that has power and makes rulings. The fact that this intellectual property was evidence in an investigation should exempt the copyright from passing to the next of kin, at least until the investigation is over and the evidence made publicly viewable first.

Honestly, this should have been exempt from copyright law as no one was reasonably intending to profit from these writings (except the Tennessee Star, who could only profit from it due to its secrecy). For my money it's Stair, Hale seems rather overtly insane and has been a hopeless case for years that was just never properly addressed.
