(Disclaimer, not 100% sure) Unlike the paperwork that the clerk files in the system during working hours (e.g. the bail bond receipts) Nick’s lawyer can submit documents electronically. For instance, the timestamps in Nick’s motion to dismiss show it was filed at 9:03 pm on a Sunday, which matches when it showed up in MCRO (August 18th).

Could be. I don’t believe the clerk has to “push it” through the system though, electronic filings just show up. It would also be strange that the clerk updated the case without the electronic filing showing up in the system.
The number of legal cases of some sort or another which have been active at some point in the last year involving the Rekietas and/or Imholtes is now up to 7 available through the MCRO website (not including 3 not available on MCRO and about 5 or 6 traffic tickets available on MCRO).

There have been online filings made on the weekend that have appeared publicly for view on the weekend, meaning no manual intervention is required. I THINK there may sometimes be a delay for filings to propagate to MCRO, but I don't think I've seen something that was delayed by a day or more.

Requesting, but not filing, a reply is not uncommon. If you’re totally fucked, a reply is just going to waste the judges time and make your arguments look worse.
Now, to me, this seems like the most likely explanation. But I don’t know how Nick’s lawyer convinced him they didn’t need a reply, but props to him for getting that through, I imagine that was a very uphill battle.
I would say not filing a reply is very unexpected when the client is a lawyer who is apparently meddling in the handling of his case (according to him, he spends most of his days reviewing discovery material), has a history of smugly streaming over his lawyers' filings, and always advocates the most aggressive approach possible.

Even if Rekieta had a sudden epiphany that he shouldn't stream about his cases, I can't imagine him co-signing the idea of not exercising the opportunity to respond when their initial motion was totally demolished.

I agree that Nick's lawyer must have had quite the time wrangling him into accepting the lack of a response.

I have no recollection of any of that at all, but perhaps I'm just good at selectively ignoring nonsense. In the rare instances where I have seen that kind of thing getting posted, it's always had immediate pushback. Not by mods, but by regular contributors. What gets me is the idea that White would wrangle him at all on this issue.

Remember, we're calling him Barneswalker for a reason. You'd expect him to be gung-ho on the argument the warrant is invalid. Before taking Nick's case, White was mouthy on Twitter about all the "constitutional issues" this case presents. Just as Barnes is.

I dunno what happened, but it's not what I expected. I expected another poorly formatted shit pleading.

I think the end result will be the same though: Motion denied.

I was trying to figure out what it was that caused Aaron to start talking publicly about the swinging and the polycule and the coke use and all the rest of it. Presumably it was some sort of resentment over the fact that April had abandoned him and moved into Chez Rekieta, but I can't help but think it's a really bad plan. On the one hand, you get some attention for your shitty stream show. On the other, everybody knows you're a cuck who probably takes it up the Gary Glitter.

But the obvious thing to do in those circumstances would be to cut ties and keep quiet. I think this is why I'm a little more generous to Aaron than he probably deserves. His decision to open his big yap and spill all the dirt about the inner workings of the Rekieta swinging scene has brought so much entertainment to so many people that I find it hard to hold his folly and his weaknesses (of which there are many) against him.

IMO Nicks lawyer / one of the paralegals called the court around 4pm and let them know that they won’t be filing a reply, This is a common courtesy to the court, so nobody’s wondering if you missed your deadline / will be coming in hot with a nunc pro tunc request for more time to file your reply one week later.
This is what I'd expect from a normal party and a professional lawyer. With these two buffoons, though, client and lawyer, I expect profoundly unprofessional behavior. I wouldn't be at all surprised if they just completely blew it off without notice.

The only reason I think Barneswalker might have actually called in as you suggest is that they took it under advisement before the strict deadline, as it generally means they think the matter is fully briefed and ready for decision.

I also agree more paper wouldn't have helped anything. The original filing is pathetic but it does raise the necessary issues, albeit inartfully. Generally, if the judge agrees with your actual arguments he isn't going to say "well you're right but your brief sucked so much that I'll rule against you anyway."

The case law says there's a high barrier for holding a Franks hearing (as the prosecution's opposition argues), but I see standards like this cited where trial courts often grant something like this anyway even if it's an act of futility just to avoid an appeal on that ground.

I long suspected and got confirmation this week that MCRO and EFS are two separate systems. I had to talk to court administration about a discrepancy between what was filed in a case versus what was showing in MCRO (they had the wrong lawyer on a case and the name that appeared on the filing side of EFS was different from what showed in MCRO).

So Balldo's Frank could have filed something in EFS, but it won't show up in MCRO until some clerk decides to enter it into MCRO.
