I believe there is an exception for crimes against children under their care, or at least that is how I understand the law. So Kayla could testify in one of the three charges that deals with child neglect.

Perhaps, but Nick is not being charged with giving his kid cocaine. All of his charges are directly related to his possession of cocaine. His gun charges are because it's illegal to possess firearms while being addicted to a controlled substance. His child endangerment charge is because in the state of Minnesota it is illegal to allow your children to be "present where someone is in possession of a controlled substance" (sauce).

As such, all of his charges are deeply entangled, and even if you were to argue that his child endangerment charges meet the exemption from spousal privilege, it would be difficult to really separate that testimony from being about the other charges. Trying to skirt the line and pull her in regardless would be difficult, and probably would open up avenues for Rackets to appeal, ultimately causing a lot more problems than her testimony is worth. What would they even tell them? He actually had 27 grams of coke?

There was still pretence that this was something that should be done in a limited way and responsibly, but he was clearly becoming enamoured by it.

I refer back to his outlook on lying. Lying, according to Nick, is not an inherently amoral act. Instead it is the effect of the lie and the damage it causes that is immoral. He states that if a lie caused 1000 dollars of damage, then the lie was 1000 dollars bad.

With such a flexible moral system, anything can be justified.

Without any evidence, I see no reason to give Nick either optimism or the benefit of the doubt. Rather, I see Nick in a situation like this:

As he and his Qover have started to progress through the court system, both in the CPS case and the criminal ones, it's becoming more and more difficult to manage his web of, "I got this." Nick's case wasn't thrown out at the omnibus, and learned scholars and practicing lawyers found Nick's motions pitiful. Qayla will be in for a rude awakening in 3 weeks. April wasn't able to get her charges immediately thrown out. Heck, even Aaron's revenge porn charges, which they so "masterfully" put together after Aaron refused an NDA, those charges seem to be unraveling a bit. (First an amended warrant, possibly more to come.)

So you have a mess, between that and 2 cranky crack hoes who can't get their fix (outside of booze), and Nick's own coping with no drugs. Plus the constant drug monitoring from CPS, which tells us that, at the very least, Nick's CPS case is still ongoing. Assuming the kids are back at all- I don't take Nick at his word with anything he says-, that means he's got another 5 people to keep gaslit with his outlandish takes and justifications.

This is what is taking up Nick's time now, maintaining this web of lies, keeping spinning all these tales as plates spinning on dowels.

The real pain comes when things start to come tumbling down.

I imagine the real hell for all of them is having to keep the house clean, having to do laundry and having to feed the kids all under the eye of CPS. Given Kayla's semi-useless state and Nick's general refusal to do much of anything, its possible to speculate that a fair amount of work is falling on April in that regard.

And to the extent which CPS was (as far as we know) unable to get any of them to talk about what actually happened leading to that positive test.

None of it legally proves anything, but it all looks bad.
