Psychiatrists don't really distinguish much between those two terms any more, and on top of that, people can go from one state to the other. Previously, Nick was pretty capable of passing for human and even for nice. Now, anyone watching him who had seen him previously can tell instantly he has some screws loose. One thing I noticed was the psychopaths had a tough time passing for human, but the sociopaths could be more convincing. One of the sociopaths, a handsome young man, referred to his two girlfriends not by name but as Bank One and Bank Two, which is how he saw them--solely as objects, financial resources, walking ATMs. That is, I think, how Rekieta sees his children. And his wife.
As dumb as Nick acts, he isn't actually dumb, or maybe he is now from the drugs (possibly permanently), but he could generally be bothered to understand something if it was in his interests to do so.It's assumed as that's how families with this kind of money would normally operate, plus the comments from other lawyers about how Nicky somehow knows a lot about how trusts work, very odd considering he doesn't know shit about law in general. It could also just be a case of 'why not both'.
