With this in mind, and the fact his lawyer mentioned Bossman has unresolved mental issues and was in the psych ward(right? he was in a nuthouse, right?), isn't there a teeny-tiny chance they go for some sort of insanity/unfit plea or something? No idea how it works over there, but BMJ is clearly not fit, like, overall. I compared him to StopSpeeding, who quit meth and booze and got his life in order, but it was clearly not a fair comparison. Our boy is very mentally unstable, more than most crackheads.

We're not getting anymore content any time soon, that's clear. I kind of wish he'd get psychiatric help. Really don't think jail will fix him in the long run. If fixing him is even possible at this point.
Bossman is mainly just an asshole. He doesn't really fit the category of insane that would be needed for the court to shift him over to psyche services. Better examples of lolcows where the court does do that are Daniel Larson and Chris Chan. They are clearly mentally ill retards unable to assist in their defense. Bossman is just an obnoxious retard who wants to fuck your mom. He's way too high function for the court to divert him like that.

Kees H already covered it, but to clarify Austin's defense wasn't trying to make an actual plea for mental incompetency. It was the typical "Muh mentals so go easy on me" comment. The judge was saying Austin had an obvious drug problem and couldnt finish rehab, the attorney tried to counter that he also had some underlying mental issues that werent being treated at the time of being kicked out of rehab but now he's on his meds so he's all good let him out so he can go back to rehab it'll TOTALLY work this time.

If there was actual desire to go down a mental path the attorney would make a case for why he thought Austin was incompetent to stand trial and would then request the judge order an evaluation and mental competncy hearing. Which would aboslutely drag out the case even further. All while Austin is in jail without bond.

I will say he did look better last week. If he's been taking his meds in jail (wasnt discussed what. just that he was medicated) it usually takes a few weeks to titrate in his system. We've seen Austin on his meds before. He obviously is wackadoo, but not wackadoo enough to

A: Not have the mental capacity (not to be confused with intelligence) to aid in his defense [incompetent to stand trial]
or
B: Not have had the mental capacity to understand what he was doing at the time was a crime [not guilty by reason of insanity]
 
Some people like to believe Evil Eddie doesn't have wetboys running ops on his payroll. Here we have the guy who's been KOing Ratdad and he feels untouchable enough to start taunting now that he's back in Eddie lair where US law can't touch him.

Nope Bossman knew what he was doing, knows right from wrong and doesn't have a serious mental illness that would cause that like schizophrenia.

He REALLY screwed himself by getting kicked out of rehab and then attacking Ratdad again.
If he had STFU, did his rehab, left Ratdad alone and THEN went and got some mental help, his lawyer could have used the
"troubled man with an addiction problem and mental health issues all that he's with dealing with SEE" !

Instead Bossman said a big FU to the judge, rehab, the shrinks and Ratdad so his ass is in jail and he'll be sentenced to jail time. How long is up to the judge.

In Austin’s case, he’d be held in a mental institution until declared mentally fit, and then stand trial.

If you go to trial and are found “not guilty by reason of insanity” then you’re condemned to a mental institution until deemed fit to be released, which means you’d spend your life in a mental institution, which is generally worse and more restrictive than prison.

To clarify, when a defendant is found to be not competent to stand trial, they do get held by a mental institution but the point at which they get out can depend on whether that defendant can be declared to be mentally fit and whether that defendant poses a danger to himself or others. Someone can still get out if they are incompetent if the charge is minor enough (i.e. they have already "served their time," so to speak) and the medical professionals dealing with that person don't believe that person to be dangerous. A local case we had involved a woman who was charged with Trespassing. She was and is insane, and she was held at a mental institution for a few months, but the max sentence for Trespassing in our State is 90 days. She either took a time served plea or the case was kicked and she's home

My point is that even if Austin was found to be incompetent (he's not, and protracted incompetency can be difficult to fake) he wouldn't be held in a padded cell forever or anything. Absolute worst case, he'd get out at around the same time he would have gotten out if he took a plea to the most severe count and got the maximum sentence, because keeping a case involving a defendant on trial for a non-violent offense in competency purgatory forever is a huge waste of time and money for everyone involved

If you're found incompetent to stand trial, you don't get let go if you're found competent. You go to trial. (Although you may qualify for bail at that point.) Or that's the point when you can make a plea because previously you were incompetent even to do that.

It's if you're found not guilty by reason of insanity (an entirely different thing) that you're held indefinitely.

You can be found competent to stand trial and yet later "win" a not guilty by reason of insanity.

Austin is probably not either. He's kind of dumb but he knows what is going on around him more or less.
