If he wants this dismissed, he has to beg for Mr. Hardin's permission, or for a court to order dismissal, but the court is required to deny such a motion when the non-moving party is prejudiced (like by having spent tons of money already or the moving party waiting too long to file such a request). See, broadly, FRCP 41 (a) (1) (A) and Ohlander v. Larson, 114 F.3d 1531 (10th Cir. 1997)

The judge stated that Greer's IFP status came into this and makes it hard to slap large sanctions on someone. I think everyone here got a little bit too excited yesterday. Yes things are going really badly for Greer. No Greer isn't about to be turbonuked at High Noon. This lawsuit is not over yet but it is going in the direction that is good AND it is unlikely Greer can change the direction this case is going.5K was a very reasonable amount for the work put in by Hardin. Is it because Melonhead is homeless I wonder? Maybe the magistrate settle on an amount he feels Ratface can realistically pay? But 5K in legal costs is nothing on the average.
