I guess it depends on what the laws regarding gender identity and incarceration are wherever Phil would be hypothetically jailed/imprisoned. I know Oregon, especially Portland, has very "progressive" laws regarding gender identity, so dependent on if he were in a local jail it could be just identifying as female could be enough, but a federal prison wouldn't allow it even with surgery. Surgery which Phil has never had and has only lied about.

If I were a female inmate and told my new cellmate was going to be an MtF, shut up or be thrown in the hole for transphobia, Phil would honestly be a relief.

While the vast majority of violent crimes are committed by males, the kind of women who actually end up in prison instead of just on probation or whatever for minor drug/theft type things are generally disproportionately of the unusual sort of women who aren't afraid of cutting a bitch.
