Dear god I'd love it if Trump's team invoked National Security interests and shoveled all this horseshit over to the FISA courts. None of that is constitutional either, but these same faggot judges have been complicit in supporting it for two decades, so let them fight
that battle too just for added fun.
For those unaware/unfamiliar, the FISA court was spawned in the late 70's as part of a foreign anti-espionage bill. Remember all those civil rights the government's not supposed to infringe (as per the Constitution and its amendments)? lol no ... and SCOTUS has repeatedly backed the FISA court over that kind of shit. You can literally be sent a "National Security Letter" ordering you to shut the fuck up, say nothing to anyone under penalty of imprisonment, and present yourself to the FISA court (in secret), where a complete case can be made against you, without any right to review (or even be give any access to) the evidence against you, no public oversight, and all sorts of other kangaroo court shit.
And the government can sweep any case it wants straight over to them at will. If it did that for this case, every attorney, politician and judge currently involved would be stonewalled, shut out completely and removed entirely from the whole thing, and there's fuck all they can do about it without dismantling FISA. Whoops.
Correct me if I’m wrong but they have no authority whatsoever to tell the military to do anything and it’s an insane power grab.
You're completely correct. Even a fucking E1 still in basic training doesn't answer to civilian judges for "orders" concerning military operations. The military can (and absolutely should) tell this judge, to his face, in person, to respectfully go fuck himself. The three branches of government are separated the way they are
explicitly to prevent the military from being "split-brained" and abused like this by multiple branches. You're in the legislature or judiciary and want the military to do something? Better ask the executive reeeeeeeally politely. And whoops, the executive seems to be rather pissed at the judiciary at the moment. Whoops.
